My wonderful STBX bride was orderd at the temporary hearing to pay me $100 a week child support. She made the first three payments and then when she was supposed to give me the 4th last night she said she didn't have it.
Since she is drawing unemployment only as income, she gets an amount deposited on a debit card, which she pulls out as cash at an ATM. She has no checking acount either, so I bought a reciept book and she paid me cash three times, and I wrote her a reciept for it so we both would have a record of payment, trying to be nice.
She is unpredictable, and I should have known better to start with, does anyone know if unemployment can be garnished?

Yes it can. I had it garnished from my ex husband

YES it can be garnished!...My current husband is on unemployment, and the Attorney General gets CS, before he (my husband) gets his unemployment.

Yes it can. You will have to go to court/mediator to get this set up. Seriously, it sounds like you will have a life time of anguish getting her to pay. My daughter goes through the same thing with her son. He doesn't work but is court ordered and gets it out of his unemployment. I will tell you the same thing I told her, support your child and yourself and move on. She doesn't have the money to keep taking him back to court and we believe he will work off and on and it will always be like this. If you have the money to do it by all means,do it. Ask her to give up total custody in lie of paying any child support so you can be done with her all together. I used to think that children need both parents but some parents aren't fit enough to provide sometimes. If they do more harm than good to the children, they don't need to be with them. I'm talking drug addicts,drinkers,abusers ect. A mediator which you don't have to pay for and is court appointed will get it set up (and ask for garnishment of wages either way) . If you go thru family services for child support, they will go after her in the future. Good luck

YES! The only time I ever got CS was when my ex was receiving unemployment. First you have to have a court order (which you do) then you need to take the court order to your local department of human services child support division, or whatever your state child support division is called. If you dont know where it is you're local health department can tell you. From there you just set up an appointment to give them the court order and fill out some paper work. Then you will get your own debit card for the child support to be deposited on. They will automatically garnish the unemployment and you will have your money within a few days after it's garnished every week. Good Luck!

I work for the Dept of Labor in my state, and I can tell you it can and IS done, regularly. Contact your state's family support division and explain the situation. You will most likely have to fill out a form but it can be done. It is usually run through a dept. called the "offset program" meaning they offset things such as unemployment and tax returns to get the support you need.

how long does it take to get a court order? i will have to start paying CS since i have a good job and my ex decides not to work, but i don't know when because he owes me for a small claims judgement. the judge took this into consideration at the hearing over 2 months ago. but my ex was the one with the attorney and he was supposed to draft the order. now he doesn't have an attorney anymore and there's still no order. i don't want to owe for CS but i also don't want to pay my ex unless i see it in writing.
