You'll need to reference your divorce decree and consult with a tax advisor. My decree contained multiple pages on how taxes would be handled. For instance, even though my ex bought me out of our marital house I had it written in the divorce decree that for that year I would be able to claim all property taxes and interest. Also verbiage was jncluded that he pays taxes on my alimony. It really is dependent on what you agreed on during you divorce settlement.

Thanks for the reply. We owned no property and had no children or anything so we didn't really have to fill out any of the tax stuff listed under housing and property and such. No alimony or any money owed to anyone. I will have to go back and look at it. Thanks though!

If it wasn't addressed in your divorce decree then I am fairly certain as long as you were divorced on or before 12/31/14 then you can file as single.

Yeah. I have looked at the IRS site and that's the info they give. My ex husband wants to file together because he is most likely going to owe If he files by himself. Ive been in school so that has helped us not to owe but now he doesn't have that without me. He got half my life's savings and I assumed our 10 thousand dollar car loan so I don't feel that bad if he owes!

I am in the same boat. By stbx is not smart enough to bring this up at settlement. I have been paying all expenses for 8 months now. And I am sure she will not want to use my accountant I have had for 20 years now. And I will not change to one she comes up with period.
So I plan on claiming all the interest and taxes unless the judgement says different.

You are correct. You file based on your status as of December 31. My divorce was final a few years ago, at the end of December, and I filed single.

You can't file married, as you were divorced on Dec 31st.

I was divorced in October and we filed married because all those previous months our withholding was at a married rate. We would have had to pay a lot of taxes. This was in 2009 so I am not sure if there have been changes regarding that. We did not put it in the decree, but the lawyer said we could do either way. We split the refund 50/50. That was just for 2009, after that we did ours separate

I was only married for three months we got married in July and I left in October. The tax lady told me I had a choice to either file single or married and filing married was a difference of about $3000. I was the only one that worked and he had a daughter that he had skipped out on paying child support so they were garnishing part of his disability every month. So part of the tax return went to pay off HIS child support and I got the rest. Maybe you can have the tax person do it both ways to see which is better for you.

I forgot to add, the tax lady said because we were married the last 3/4s of the year we were technically supposed to file jointly.

We were divorced in April, and were advised to file single. We agreed in our settlement that my ex-wife will claim our son in even years (this year) and I will claim him in odd years as I pay child-support plus half of private school tuition. However, it is never really that clean.

She refinanced the mortgage to buy out most of my equity, but I was paying the mortgage through April, so technically we should split mortgage interest through April 50/50, and property taxes were paid in January and July, so should I get half of those taxes, or half of the January payment? Lot's to work through. On the other hand, since I am on my own now and renting, I may not be able to itemize anyway, in which case it should all go to her so someone benefits from it. We'll see.

In any event, yes you can both file single in my opinion.
