hello everyone. I'm a 40 year old man.Early on in my marriage I hurt my back at work and my wife had to get a job while I went thru surgeries. I've been disabled to work for over 10 years.

I've been the stay at home dad, my wife currently has changed and filed for divorce. Mid life crisis? I think so.

Currently after I've been taking kids to school, homework, taking care of them. She wants full custody of kids and wants to take them from there home. All my kids have allways came to me for anything, and especially lately since it's all about her lately. I know how woman usually get the children in divorce. But I have been there like moms do. And they are my whole world.

I want to know if anyone thinks I should be able to get custody of my kids even know I'm a man. Or what you think my chances are?? We both still live together, but it's torture for me. Not so much for her. I haven't been meeting people. I don't work. I stay at home and do all house work and take care of my three children. I know I need to have friends but my kids have kept me so busy for so long., it drives me crazy to think she could take our kids from me just because society tells us that's what normally happens..

I'm sorry you are going through this. I don't have any advice to give you other than you need to get a lawyer. My Brother-in-law got full custody of his daughter and that was 30 years ago.

Im sorry you're going through this as well.

If you've been their primary care giver and can support them I'm sure the courts will take this into consideration.

The courts will do whats in the best interest of the children, and they don't like to upset their home routine.

I too think a lawyer would be your best bet. Yes they cost money but when their are children, assets and support involved it's worth it.

Hang in there. It's stressful I know but we can get through it :)

Get a lawye, and if you have no funds,m the lawyer can attach your wife's wages to pay for your legal costs.

You should no presume that she'll get the kids.

is she cheating? does she think you are not good with the kids? what?

You could also ask that she pay you support since you have taken care of the children while she worked. Go talk to several attys about keeping custody of your children.

Seems your chances would be good to get custody, she would have to pay for child support. The judge will look at history and how well the kids are adjusted, may even talk to the kids about what they want. Many guys I know are getting custody these days and 50-50 custody happens all the time where I live. Good luck with it and kudos for putting your kids first and being a stay-at-home Dad!

You could get the kids, you may not. If you leave it in the hands of the court system, there is never a straight "fair" turnout for the kids.
Judge could say you are disabled and don't have money to support them. Judge may say your stbx needs to pay you support and she gets the kids. Judge might say you have joint custody, you get the kids during the week, she gets them on the weekend and she doesn't pay you anything.. If you have no money and she does, the court might have her pay you alimony, but if joint custody, then no money for the kids.. There are lots of scenarios. You need an attorney - and they are costly. be prepared to pay half of an attorney, fee for the kids to be represented in court.
Divorce is not a pleasant experience for anyone.

Thank you, the wife had told me how great of a dad I am, but I think she is just after them cause she knows that will hurt me the most.... I'm feeling way more confident in getting my kids since I'm the only primary provider. She does hardly nothing with them! I get plenty of money from disability sssi.but only under half what she makes. So yes on alimony!
