Thank you Deb. I always feel guilty for coming back to cry on people shoulders. I try to spread my wings and fly but the damn things keep getting clipped!! I appreciate the people here who keep putting the wind back in my sails more than I can ever express!

See a different lawyer...I have been in HR over 20years...in an at will state...They have to have just cause to not provide you unemployment. Go to the labor board, contact your congressman and appeal the decision... you will get retro back to the day they fired you. Wells Fargo is a large company with more than 50 employees...they are wrong.. Hugs to you hang in there

Thanks Gotta but here is how they did it. I was an underwriter we had 14 in my group. We were told we had to do 5 files per day. We only did overflow and got in between 18 and 30 per day, if you do the math 5 per day was not possible for all. The day I told my boss I was going to need surgery I was given a written warning for not meeting my 5 loan quota, I answered in writing that I was not provided 5 loans a day to do. about 25 days later. I told my boss when my surgery was scheduled and that I would be out 8 weeks I was called in and termintated. They told me I had been formally warned. I questioned the fact that the others were not doing their five either. I was told we were only talking about me and I did not know what the other did or if they too were being "talked" to. Not true we keep a big board in the office with everyones name on it and the daily and weekly total of loans underwritten we displayed for all to see! Out of the 14 I was always in the top 5, most times top 3 aand a couple of weeks I was actually the top producer. It was just what they "used" to get me off the payroll. One lady NEVER did more than two a day. As a matter of fact she called me today to see how I was doing and said she still can only get two a day completed (she is slow on the computer). She is still there?? I have appealled with the state but even if I win I get $275.00 per week! I was making $1300.00 per week. It is just unfair and crappy!! I just have to find my inner strength somehow and get past it. I hate not being well and not being able to fight back. I will get back on top, I have to I am a MOM but damn!!! Right now crying seems to be all I can muster up!!

I'm no HR person but what they did sounds pretty damn close to illegal. Get any documentation you can and follow Gottabreath's advice, and good luck to you!

Thanks "Tired" Don't know if it was against the law but it was damn sure wrong!!! From what I understand from seeking legal advise. Wells is famous for this type of thing and they cover their big asses pretty well. I just have to gather myself, heal and try to find a better employer. If you use Wells, know they are "not nice people"!! Guess that is why they are still in business it is all about proffit for them and to them!!

So what did you and all of us learn from this? - Don't give an employer warning that you have to have surgery. I guess next time - heaven forbid, you have to have someone call work that morning and say you are having emergency surgery.

I'm sorry you are going through this. Rest up and get back on your feet kicking and screaming and don't let them get you down.
