Did he get the policy before you separated. I have a policy on my ex and he has one on me in case one of us has to look after the kids due to the death of the other.

I also have life insurance on both kids, I got it when they were 3 months old, the premium was so low and they will have it for the rest of their lives

The policy was taken out after we separated. I have sole custody of my son. He hasn't seen him in almost 2 years and lives 800 miles away. It just feels creepy, and to know it was done without a word...

I continue to keep my wife insured (but we are not divorced yet, just separated until the final agreement is signed). My thinking is that if something happens to her then my kids will have some protection for the aftermath. It could be as simple as that, especially if it was taken out when you were separated and before the divorce was final.

The only way to really know would be for you to ask your ex, and I would guess from what you write that doing that would be almost impossible.

If you should die, he'd have to take care of your son...and probably pay someone to do it. So it's all legal.

But considering your ex.....yeah...it's strange...very strange.

On the other hand.....the policy pretty much "insures" that the police would investigate him if you died...

If you were to die, your ex would apply to the Social Security Administration for "survivors benefits" for any minor children.

Here is what I did when I separated and was divorcing and had a minor child. I had a Will prepared that contained very specific sections that allowed my relatives to sue a party on behalf on my son if my relatives believed my death was suspicious or wrongful. Then any money they obtained, was to be put in a trust for my son for payment of expenses of my son. My one relative in would be in charge of the trust and in charge of review of expenses so they meet his approval, approval of payment of expenses and distribution of expense payments (in case my ex was not responsible for my death and got my son). My ex would have to provide proof of all expenses to satisfy that relative in order to get payments from the trust.

You could place a notarized statement with your Will and that statement will include full details of your ex's attempt to kill you AND that you discovered your ex took out an insurance policy on your life after you two separated, and that this made you concerned. If anything should happen to you, you ask that this statement be taken into consideration by the police and any and all investigating authorities.

huh? little creepy. mine took out a life ins. policy on himself and named me as beneficiary.......this was during the pending divorce. and he has never changed it.

Just a thought, but in his mind, by now he probably realizes he did wrong by you and this may be his way of trying to ease that guilt. That if he dies, you get the payoff.

actually, it is the other way around if i read the op correctly. he has insured Namaste, his ex-wife, and that understandably bothers her.

Yes, I was insured post divorce.

He is active duty mi.itary and thus required to be insured himself, with my son as the beneficiary.

I'm just boggled that anyone can insure anyone without consent or knowing. And his past violent history is unnerving.
