Friday we will be having our first meeting in months at the court house with our attorneys. We have had no contact, no emails, no text messages nothing and I am so afraid I will fall apart. It is a motion filed by her to get me and my 99 year old mother out of our home so she can sell it. (I am also a female). There has been a habit of dishonesty and some that has been pretty damaging and cruel and that seems to have no impact on how I have ended up so broke that I cannot find housing that I can afford. I am stuck. It feels as though when I try to explain my dilemma the attorney puts it in the department of just a nasty divorce and he's heard it before so why don't we move along because this is probably a she said she said thing. The narcissist liar is so unbelievable that It seems my attorney is either not believing it or this hearing is not the time or the place. I expect to see fraudulent paperwork at this meeting and I don't know how to handle these lies that are going to break me further. I don't feel like I am going to sign anything until I see some truth surface that may serve to get me out of this nightmare. Has anyone ever heard of filing for damages in Civil Court?
It sounds like your attorney is not looking out for your best interests. It might be time BEFORE you go do court, to fire his a$$ and get a new, better one who can look out for you. That might negate the need to file a separate suit.

First, is your attorney with legal aid, or have you paid your attorney?
Here's the thing about attorneys: They are bound by law and codes of professional conduct to do EXACTLY as you instruct. No matter how absurd or silly your instructions, the attorney must do it and, more, actually try to get you exactly what you want. YOU are driving the bus, NOT your attorney. Changing horses mid stream tends to be a bad idea. It costs you more, makes everything take longer, and may annoy the judge. Unless your attorney is a useless dumbass, I recommend you just "put your foot down." Squeaky wheels get grease. Always.
However... You are obliged to pay for your attorney's time in advancing whatever position you want to take. Sure, you CAN tell your attorney to demand that your STBX paint rainbows on the house, install a water slide, and pay you $1,000 per month in alimony. But (depending on your fee arrangement) you have to pay your attorney to fight all those fights. So be frugal and pick your battles wisely.
Prepare a short, concise, streamlined but VERY clear set of instructions and demands. Email it to your attorney. Sit back and enjoy the fireworks.
