I don't want to do this

meeting with a lawyer today. I got the summons for the custody papers he filed this past Saturday. I don't really understand the, so I set up a meeting with a lawyer today. I don't want to do this. My heart is pounding. I would never keep his son from him and I don't know why he thinks we need to go thru the courts. It's says we have a "working together" meeting December 15th. He is asking for 50/50 custody with support. I have 28 days to respond. Respond to what? He says he does not want support from me but they made him file that way!?! Do they make u file that way?

If you're in the United States, child support is a CHILDREN's RIGHT. The divorce decree often addresses it, but it can never be "given or negotiated away". And it's always open for modification (although some states limit that to every 3 years). Between you and your ex...you can just refused to accept it, but if someone else ended up with custody (or partial custody) for any reason (death, severe parental injury, prison, abuse, even if the STATE ends up with custody)...then THAT party would receive the child support.

I think that all states now have "Child Support Calculators"...usually available online. Plug in the numbers asked...and it will tell you what the child support will be. Google your 'state' and "child support calculator".

You cannot leave this important thing to just your word or his. a legally-binding agreement is what is best for the children. Do not see it as an attack on you that a formal document gets prepared. Rely on your lawyer.

Christi, I am going through the exact same thing. Here in Florida the verbiage is automatically put in the papers, however if you both agree to 50/50 a crossed the board, the judge waves the child support... at least that is what I am being told.

I started out with out an attorney, as I was not wanting to actually get divorce and I have thought and hoped things would work out... but I was wrong, she got very nasty and our son was the one who was going to suffer the most, so while I wished I didn't have to... an attorney advise and wisdom is necessary it seems. (I agree with jimthzz).

50/50 custody usually means he won't have to give you any child support. I'm assuming that is what he wants because it would definitely be in his favor. He is asking for 50/50 custody with support. You need to talk to an atty and find out just what this means and how it will affect you and the children.
