You don't say why he had one and you didn't, but that doesn't sound good to me at all.
I'm interested to see what others have to say, but I did have a lawyer and had to go back to court repeatedly to get a judge to order him to comply.
In my humble opinion, without knowing the circumstances of your divorce, you were taken advantage of, and he's continuing to try to do that.
I don't think his lawyer is going to be to helpful. The lawyers can't enforce orders, only a judge can, and she might just tell you to take him to court (more money for her).
You can try to get to her yourself by talking to her, but as ClearDay said, the best way to get someone to follow a court order is to keep the court involved.
If that is not the problem, then go to Divorce.com or Divorce360.com and research your issue there to see what you can do
You could contact some attorneys who either do pro-bono work or offer free consultations. You could also contact the court where the divorce decree / court order was finalized and ask what your options are. I would think you can take him back to court yourself. But if it were me, I'd only do that armed w/all the legal knowledge I could find. Many states post a lot of laws/rules about divorce on their websites.
Depending on how long you were married, many states have guidelines set up for alimony/spousal support. Just to make sure you got a fair deal. If your settlement doesn't fall into those guidelines, then you might ask the court to order a more fair settlement.
I am just groaning at the thought of going back to court. Our divorce took three years before it was finally settled. I'll do it if that's the only way, but uggghhhh.
I started my case with a lawyer, but halfway through she had to drop out due to a medical condition. That's a whole other kettle of fish. I finished the divorce on my own and I am proud and pleased with the outcome, it was very fair. I'm just stuck now with no one to call when he won't comply.
(Also I'm annoyed. Typical of him to think the law just doesn't apply to him!)
Thank you for the help and input!
Check w/the court (that issued the divorce decree) clerk to see if you can file a contempt of court charge on your own. If they do, then, I think it becomes the court against him.
He's banking on the fact that you won't be bothered taking him back to court.
My ex did too. I was tired and stressed, basically had a "nervous breakdown ". With the help of friends I found the strength. My ex was shocked. He lost. The judge even told him off.
I know what it's like, I've been there. Just know if you let him get away with non compliance now, he will just keep doing it.
File contempt on him and maybe he will honor the rest of the terms in your divorce. It took three court hearings and the threat of going to jail to convince the ex to pay what he owed me. I hope you only have to do this once.
