What is more important?
Besides...Why do I always have to be nice and give in? Right now she makes more money than I do and she probably just got a FAT tax return. I am tried of this.
She needs to do this on her own and take care of this. I am tired of giving in.
Listen. If you pay the $450, you will at least have peace of mind that it is done, because you will be in contact with the bank.
It doesn't matter if you are on the deed or not, it's all about the mortgage. This requires refinancing.
If your freedom and life with your future wife is not worth $450, then your only other option is to buy the entire fucking house.
If push comes to shove I may pay this, but for now I am saying NO! I am tired of dealing with her pathetic crap. I am divorced to her and she is still causing issues. She has no sense of duty at all. If she took the house she needs to deal with the house and leave me out of it.
It all goes back to the point I am sick and tired of being pushed around. The end of the marriage I was pushed around by her and even struck by her. I always was the one to give in, make things right, and allow her to be pasified. I have no more ties to her, no need to keep her happy, no need to be the good guy and bail her stupid ass out. She needs to take care of her end of the bargin! Period!
My best advice....say no for now, and if she pushes it, say that you'll give her some of the money AFTER she gets it done...not before...not during the process...but AFTER. That's freedom, cheaper than paying a lawyer....and not being a pushover.
You can tell her you will pay for after the fact , when she shows you copies of the new loan agreement and title papers.
Good Luck.
Can she do a no-cost refi (Wells Fargo offers, among a couple others) and simply refinance in her name only?
Plus there are two issues: Your name on the house (deed) and your name on the debt (mortgage). Which is it?
We did not clarify in our decree, she had to refinance within one month after I signed the house over to her. There was only 7 years left on the mortgage, when she refinances she took out all the equity and took up the years to 30 again. So when she sold the house a year later there was no more money left (which she stated was all my fault for not guiding her, true story)
Get the value and the equity documented now, state that she is not able to use your amount of money without prior authorization from you....
I will suck up my share and Mr Wonderful can suck up his. We have quit claim deeds set in place for the day of the divorce in my case.
I agree with Patti to wait until afterwards. However, my understanding is your signiture is needed, so can you go to the bank together (give her a few dates then stick to it) to make sure it gets done?
I made a mistake when I did this then but I am wondering if I can contact the lender and speak with them about my options.
So, your ex needs to refinance, and if it costs you money to do it, pay it, because it is the only way to make sure you are done with it.
Then, quit claim deed the title.
If your decree only states that she gets the house and you have no quitclaimed the deed, you still own half the house. Even though the decree says that she gets the house, she doesn't have it until you quitclaim the deed. You can force her to refinance, assuming her own costs, by telling her that you will not give up your half of the house until she refinances.
