My attitude is, someone can serve you a summons for primary custody all day, but they have to prove why YOU shouldn't have it, in the mean time.

Had my X attempted primary custody, he would've went down a very long, trying road he didn't have the time, or money, to deal with like I did.

Plus to prove me a mother NOT able to have primary custody? Yeaaah...I don't think so.

I know you're exhausted...it's sounds exhausting. Find your strength, keep your head on straight, and keep being a fighter like you are.

I agree with trying. He has to prove why you shouldn't have primary custody.

In most states, he doesn't have a chance so chin up and stay strong...we got your back :)

Be aware that suing for primary custody is often a tact that a spouse will take to affect the outcome of the settlement.

Don't be surprised if you later hear some type of offer that goes like this: "Gee, if you were to reduce the amount of child support/spousal support/amount from my retirement that you want, I will agree to let you have primary custody."

Be aware that he has to prove that you are unfit for primary custody and that is not easy to do. Talk to your lawyer and stay calm.

thanks guys and I had my counseling session today so hooray for looking onward and upward :-)

My STBX during divorce announced he wanted my son for all the summers. He didn't consider that he hadn't seen my son since we separated many months before and didn't want to see him, was referring to the boy in papers as "her son" and wasn't even even sending him holiday/birthday cards or presents. Plus he refused to divulge his phone number or his residence (although I knew his residence, but he didn't know it).

My attorney told me my STBX didn't want the boy and she's been through this enough to recognize who really wants the kids and who doesn't, and this was simply a bargaining tactic and to ignore it. My attorney was absolutely right.

Oh I know its just a bargaining tactic so I don't leave him living in the streets. It's not about our daughter at all. He can claim that all he wants but his actions prove otherwise.

I have a pic of when I actually was physically bruised when he pushed a phone into my face. I don't think I am going to have many issues obtaining primary custody.

Can we still kick his butt if we come across him? I haven't kicked any one's butt in so long and I've been good and that sucks. I think I'd like to put my electric scooter into top speed and run him like he was a speed bump and leave tire tracks on them. Then take the sign off the soda machine that says "any selection 75 cents" and put that on his back.
