I'm about to get served. Does anyone know what happens after that? When do we start dividing up property and all that stuff. Anyone out there with the time to school me on the steps I'm being forced to take.

I'm in the middle of the divorce...so here goes...
First the lawyers will do a discovery(finding out every asset,accounts you own jointly).Then you go back and forth with proposals til you both come to an agreement of splitting assets.You have children so you may have a court date for child support(not sure how that works as my kids are grown).Alot depends on how much assets you have and how many games your stbx plays or hides assets.It can be a lengthy and very emotional rollercoaster ride...so buckle up

Damn I got told to leave and what I could have then how much child support I had to pay.And shes the one that had the affair.Get a lawyer money well spent.I didnt because I believed all her lies (it will be ok I just need sometime we can work on it )BS

Careful with the header! I thought maybe it was a ringing endorsement for divorce!

Rules vary by state: some states have 1 year; some 2 months. Just depends. Most divide marital assets 50/50 regardless of circumstances. Best of luck to you!

depends on where u are hun.. with my first divorce.. I got the lawyer, told him what i wanted in the paperwork.. had no property to split.. so he just put a general property settlement that we had agreed on things ourselves.. i took them to him. we signed.. and 2 months later.. bam divorced.. I only saw the attorney a total of twice... to pay the first half, get the paperwork.. then to go get the final papers from his secretary.. And I never had to go to court..

Advice. Do as much as posible by yourself.

Go to a lawyer to see what is more or less standard in your state.

And time isn't much of an issue. Take your time, and try not to make the financial decisions emotional.

See if your stbx will more or less take the standard split up and avoid court.

Now if they own their own business or are self employed it's more difficult.

If you get child support or alimony...always get the option to get it paid through the system.

There are child support calculators on line to tell you how much you are likely to get based on your state.

Same thing with alimony...but your lawyer can tell you more.

Don't fight for every last thing, but ask for a little more to begin with.

Work on making a plan for the future now. Are you going back to school? Where would you like to live?

And don't get involved in fighting for things that can't get enforced anyway...
Like in my state, he's free to date and live with whoever he wants from the time he moved out. So no point in my asking that he keep his girlfriend away from the kids. States differ on these issues.

Keep it as simple as possible.
