I haven't had this experience yet...but I haven't had "major" dental or medical bills for my son yet, so we will see if ex drops the ball. My son is, also, covered under my x's insurance, but I get why this sucks!
Now, like Aurora said, HOW does he get away with it?
I don't know exactly how your divorce decree is worded, but you should re-read it. You may be able to contact him and if he refuses that go for a judgment in court against him. I discovered years ago that you can satisfy judgments by having the appropriate party walk in the business if an ex owns it and take all the money from the cash register or even take property from the business, garnish his wages, if his car/truck is paid off then it can be taken and sold and begin taking stuff he has.
I'm really NOT looking forward to this. My ex is active duty military. The Army only pays a small percentage of the work. My decree states he is to pay 69% of unpaid medical, camps, sports/equipment, etc. I've never seen a dime of it, just do it on my own. He screams that that is what my child support is for...which, by the courts...is in addition( his percentage) to CS. I don't even have an address for where he lives. (Out of state). I've been paying 100% of the extras...sports, glasses, contact lenses, etc. for these past 7 years.
The sad part? He refuses to pay. For me to rehire my atty and go back to court, will probably cost as much as what I'd have to shell out anyway...or close to it.
Crap. It's just crap.
I need to change my attitude. And find a way to make it work.
