if you are on the account you are, unfortunately, legally responsible for it also.

You need to get your name off that account. I am the co-signer to my stbx car, which he is not paying and I'm trying to get out of that.

Our seperation agreement says he is responsible for all of the finances. Business and house. It says, and I quote..."Husband shall be solely liable for any and all expenses with regard to said home, including any debt related thereto." And with the business it says..."Wife relinquishes any right, title or interest she may have had in such business and Husband assumes sole liabilty for any debt relaited to such business." Does that help? He does not get a paycheck, he is self employed.

you signed a contract with the bank that you were responsible for the account.

if it is a business than you can have your name removed by documenting you are dissolving from the business.

if it is a personal checking account you have to close it out to remove your name...

time to speak to a lawyer. he is already in financial trouble and writing you rubber checks. you have to protect you and the kids. and that really really sucks that he could do that. my ex owes me 1300.00 and it sucks that he won't pay me. what go around comes around.

If you know for a fact that your stbx is going to be depositing some money into that account soon, then you might want to wait for that before closing the account. The reason I say that is that you may make stbx mad by closing the account and so he may just leave you hanging with part or all of that current negative balance. However, if you wait, then you are taking a chance that he may not deposit anything into that account an may even make that negative balance larger.

I talked to National City a couple months ago about my joint account. I was told that either person could close the account without consent of the other. That would stop any and all transactions from being posted to the account. Of course, the account will not be officially closed until the balance is zero.

Thanks for all of your advice. I think I will go to the bank and ask the woman, who I know, what I should do. I thnk I can get my name off without closing the account. Maybe thats wrong, but I think I will try.

My bank wouldn't allow me to take my name off the joint account without his consent. However, they told me either party could close the joint account without the other person's consent. I closed the account. Be careful, I hope you don't get stuck owing that balance.

I go thru the same thing, I am in the process of garnishing his wages so I don't have to go thru it anymore. Since he served with papers last month he is being super nice even called to say he will be a day or two late. But because this is a sistuation he caused he will have to pay for the atty fees, which really pisses him off.Sorry but don't write me a check I can't cash !!!!
