Please help!! I'm as mess today..I was presented a week and a half ago with my stbx divorce proposal. I went to my lawyers on Monday and we went through what I agreed to,and what modifications I wanted..she faxed it to his lawyer as it was a holiday and court was today. She advised when we got to court the a.m. that his lawyer didn't even get time to go over it..then she tells me she thinks its going to trial!! She went into chambers for about 10 minutes,said it was getting heated and she just said she wants a trial date set!!Now its set for Dec. 12th!! Really? am I nuts that this was a little hasty? Where in the world was the was there trying to figure this out between us? I thought a trial was the last resort? I would love to know if this is common..and what do I do now? I would like to settle some things..I have even told her what we could give in on..my main lawyer I signed with thought we were near the end so she gave it to this jr. attorney..I'm not happy with her and want to go back to the main one who is a fighter..I was told all I have to do is ask to be put back on the main lawyers calendar..which I will..but I'm worried that less than 1 month is not enough time..my stbx was ordered last Sept..yes..over 1 year ago..to have his collectibles appraised..he never has!!how can we resolve that when we dont even know the value??
It is time to talk to the higher level attorney and explain that you feel something went wrong when the jr. atty took over and somehow what appeared to be potentially over, has now veered into trial. There was no negotiation to your knowledge, just the case put into trial. Ask what happened and why weren't you advised and fully explained of the situation by the jr. atty because right now you're in the dark as to what happened in chambers.
Also, since your ex hasn't complied and submitted his figures on the collectibles, how will trial be accomplished on that date? And who from the office is assigned to jump on that issue?
Explain to the higher level atty that you want someone else worrying about these details, but you also want to be advised what happens by people and you want copies sent to you of letters that go out so you know what happens. .
