Then comes along my ex-sister in law wanting money that neither her of my nephew were entitaled to. SO that has been an expencive fight also. I have a lot of resentment for my brother leaving me here to take care of all this crap alone. I have a lot of resentment for my parents for always taking advantage of me and then putting me in this situation.
I really feel for you and understand your feelings! It sucks when everyone is out for there selves and just want to reap benefits and not help with anything. I am sorry your are going through this. People show their true colors when someone dies and now you know what you have for family. :( I have had no help or support from any of my family except my dads sister. She was the only one that bothered to help me with anything. :(
Then on top of it all fighting with family over the estate.
The only thing I know to say about family fights is to pick your battles. If you are the executor of the will, odds are you have a lot of discretion, and hopefully there is a clause in the will that prevents other heirs from taking you to court.
Please, by all means, keep coming here and venting. This is a great place to do just that!
Hugs to all
It seemed like brother and sister did show up for a little bit, but when they were tired of it they had someone to dump it on: you.
It seems like you are the only one that has any real grief over losing your mom. It seems like they grieved and moved on pretty quickly. Find out if your sister is entitled to any money. I do not blame you for being resentful and I anytime I could I'd remind them that I was the one dealing with everything.
I have definitely learned how hard it is when someone dies. The Aftermath just keeps going and going.
The will also says that my niece and nephew can NOT sue me because they think that I did not dispose of the assets for as much money as they think that I should have.
It does not mean that they have to like what I do, just that they can not take me to court over it.
Now my father also charged me with being fair. So to me "fair" meant that I offered the contents of the house (which were mine!) to my late sister's husband, my wife, my children, my niece, my nephew, and other family members as expressed an interest.
Once again, my word on who gets what from the house is final!!!
I can not decide to give myself 80% of the estate and 10% to each of my niece and nephew; that contradicts the will.
I can not give my children a percentage of the estate other than the house furnishings. But I can give them money from MY account (my joint account with my wife). Does not matter where I got the money.
Does that help?
The lawyer or an assigned paralegal can be with you as you file the necessary papers, they will make sure things that need to be done by certain dates get done. It will cost you, but it may be the best money you ever spend!
The grandchild's father argued that the price was fair, and he put his share of the eventual inheritance up as collateral. Since I am an in-law and not a blood relative I just urged my wife to make sure that she was comfortable with the deal.
I told my children (who are grandchildren numbers 4 and 5 out of 7) that I was OK with it. Nobody except for the eldest grandchild was the only one who lived in the area and was in the market for purchasing a home versus renting.
I don't know the $ value and the $ purchase price, but I trust my wife, brothers in law and sister in law. So as far as I'm concerned the deal is good, binding and final.
It is easier now for me, I just inherited 50% of my parent's estate so I think my wife and I are good to go for retirement when we are "old enough" to retire.
It is sad when siblings start to fight over money. I hope that your sister is able to get past this.
