I have struggled with bashful bladder for as long as I can remember, but when I hit my 40's it turned into a medical problem as it has led to pelvic floor dysfunction. As it turned into a medical problem my doctor told me it is caused by anxiety. It was hard to come to grips with a medical problem being caused by anxiety, but it is what it is. I deal with it and work around it. I had to take a drug test for the Department of Transportation and even though I payed for a drug screen from my hair, which is a much more accurate test then urine, they will not accept it, and as far as they are concerned, if I cannot pee in a cup, then I failed my drug screen. I'm so angry, and so defeated. I just spent $2,000 getting my Crane Licence, and am scheduled to start school Sept.15th to get my Commercial drivers licence, so I can drive the crane truck, and it's all for nothing because I can't pee in a cup.

Can you contact a lawyer? You may have a claim under the ADA. If you have a medical condition that makes it so you cannot pee in a cup, they may have to make accomodations for you to do the hair sample.

Seems like a simple enough thing, but talked to DOT and they said I would have to prove that I have a pre existing diagnosis. There are lots of medical records showing a problem emptying my bladder during stress, but I've never been declared disabled. The DOT is the first drug screen I have ever taken that did not accept an equivalent screening. I don't know how to become disabled, and I don't want to be declared disabled. But I'm coming to grips with the fact that it might be the only way to proceed with the Crane Operator direction I am working towards. It makes no sense to me that they cannot accept a different and better drug screening. I offered to let the Doctor cath me, I offered blood test or saliva, I'm not hiding anything, this is ridiculous.

So wait, you have to be declared disabled due to it? Won't a doctor's diagnosis or note help? I have asthma and that is considered as something that has to be considered under the ADA for purposes of "reasonable accommodation". What you are asking is more than reasonable.

I certainly hope you are right. Things would be better if they didn't fall on the weekend, and we could proceed on to know what will happen, but I have to wait to know for sure. The Man from the DOT and the people at the drug screening lab made it sound like it was not likely. The Man at the DOT asked me if I could pee other times, and I said yes,it's just under stress that I cannot, and he said, "That won't cut it." but I really won't know until someone makes an official decision next week.

How do I know what is covered under the ADA? I tried to Google information and all that comes up is how to apply for disability. I don't want disability, How do they accommodate for your asthma and how does the ADA help?

Don't give up on this. It sounds like you are talking to someone who is ignorant of the rules. If there is documentation that you have this problem, you should be able to prove it's a pre-existing condition. Ask to talk to someone's supervisor if you keep getting the same answer. Sounds like they just don't want to do extra work.
