Querying the Clearinghouse
As of January 6, 2020, all interstate and intrastate motor carriers employing commercially licensed drivers, as well as C/TPAs administering drug tests for these carriers and owner-operators must register with the Clearinghouse. Registration requires driver consent, and the records in the Clearinghouse are subject to the Privacy Act.
Once registered, employers or their designated C/TPAs must purchase a plan to query the Clearinghouse for information about regulated drivers. They can choose from a number of options for the number of queries they want to conduct. For example, a high-volume user may purchase unlimited packages for $24,000 per year.
To make the process as efficient and simple as possible, employers must ensure their driver applicants have registered with the Clearinghouse ahead of time. This will help drivers quickly give consent to their driver applications and avoid delays in the hiring process when they have to register with the Clearinghouse later.
A query in the Clearinghouse is an electronic check of a driver’s record to determine whether that driver is prohibited from performing safety-sensitive functions, such as operating a truck or other commercial motor vehicle. There are two types of queries: Limited Queries (which satisfy the annual query requirement) and Full Queries (including all pre-employment queries).
All drivers must provide specific electronic consent within the Clearinghouse system before any query can be conducted. This consent is good for multiple years.
If the query returns that a driver is prohibited, a full query must be conducted within 24 hours or the driver must be removed from any safety-sensitive position. Once a driver has been identified as prohibited, it is important to follow-up with the full query to receive detailed information about the violations in his or her Clearinghouse record.
The Clearinghouse also provides information about any resolved or unresolved violations that were not resolved through the Return-to-Duty process.
