As noted above, the district court declined to award damages against either Meyer or Continental, finding that Magic Valley had not proved actual damages and that the liquidated damage clause was void as a penalty. On appeal, Magic Valley asserts error in both of these determinations. In order to be liable for tortious interference with a noncompetition covenant, it is not necessary that the new employer actively induce the employee to leave his former position.

Meyer's employment was terminable at will, and Magic Valley does not claim entitlement to damages caused merely by his choice to leave the company. The district court's finding that Magic Valley did not prove, with reasonable certainty, actual damages caused by breach of the noncompetition covenant is supported by the trial record.
