Tree Overhanging Fence
What follows is an hilarious exchange which I had quite recently with the agent who looks after my house. Priceless!
Good Afternoon Jillian
We had a call from the tenants of the home and the neighbour (eastern side) had approached and asked if it would be possible for you to trim the branches that are hanging over the fence hitting their home?
Not sure if you were wanting to have this done – we can organise on your behalf if you would like.

Janine, I am not sure what my legal position is ? I really cannot afford the expense and really wonder why the neighbours don't just cut the bits which hang into their yard? Jill

Hi Jill,
You’re right – it is not your responsibility to prune the limbs overhanging the fence.
The neighbour’s can do it and are also entitled to throw the lopped pieces into your yard.
I have emailed the tenants asking them to relay this information to the neighbour, and to have them call me if they have any queries.

It would be funny if it didn't have the possibility of causing WWIII! I recently sent the tenants the council tip vouchers so perhaps they could use one of those? Thanks for your advice etc Jill

Hi Jill, The tenants said the couple next door are elderly so they will do the pruning for them.

Lol! So much fuss for pruning! I trimmed a lot of trees that belong to my neighbors because they were overgrown into my home. I just asked and they let me. It was much easier than this!
I agree, but I\'ve discovered that oh&s has a lot to answer for. Seemingly common sense decisions now require a permit, a ladder and a man with a stop go sign. (who has to have a ticket, of course!)
