Ok John it is done! Since you died without a Will in the State of Louisiana, the kids automatically inherit your half of everything we owned. They signed the papers over the weekend and today I gave them to Heather my Attorney. She will file them in the Courthouse this week. How I hate everyone being able to see what we have. But life goes on as they say. It was hard to read it as before I just gave them to Kristy and had her bring it to Chad to sign and I brought it to Heather. But today before giving it to my attorney, (Thank God I work with Attorney's) I decided to read it and boy was it a rough day after. I know I have accepted that you aren't coming back but this just seems to make it so final. To see everything that we acquired in our 32 years on a piece of paper seems so meaningless without you here to share it. The kids are great not fighting over anything and willing to sign it over to me. Even though I could buy them out if need be, but they will get it all in the end anyway. How I would love to give it to them now and join you. But I guess God has other plan's for me. Yesterday would not be soon enough. The Marble Headstone is being made right now for you and Joshua, how I dread seeing that up there. Well I guess I just needed to talk to you and I felt this was the best place to do it. My husband also died without a will. I live in the state of Ky and since our children were grown, they were considered heirs. They too had to sign papers one of which allowed me to be administrator of the estate. My children were 20 and 24 at the time. They had no clue as to how to be an administrator of an estate. I had lots of visits with my attorney during the year after his death. In Ky. . the estate has to be closed in a year. I had no idea there was so much involved. It was a real eye opener. The first thing I did when I hired the attorney was to make a will. I didn\'t want my children to go through what I did. Good luck with everything! Hugs. Barbara
Thanks for the comments. I have the best kids in the world 30, 25 and 22. They spoke with my attorney as soon as John died because they didn\'t want me to have anything else to worry about. They were all willing to sign over their share to me, however being my youngest one is under the age of 24 she is a forced heir and could do it but could appeal it later therefore they said it was best to get them to wait until she was old enough to sign everything over. In the meantime I can sell or spend whatever I want the only problem I would have is if I were to remarry then I would have to give them their share. Which would not be a problem cause I wouldn\'t want someone else to benefit from their Dad.
I am glad your kids were good to you. When people pass they get really funny! My in-laws wanted to take everything from me. They were trying to do it even before he was gone! Bob and I were together over 11 years & never married. He was sick as Hell & got up to the courthouse. He could barely walk or sign the papers to marry me. We had to wait 2 or 3 whole days, we didn\'t think he would make it. We were married at Hospice--he died 16 days later, they received nothing unless I gave it to them. It wasn\'t that I wanted to keep everything and would never in a million years do that but they wanted EVERYTHING he & I had. I literally had no idea how to separate any of that. He didn\'t want that or me to have to deal with it...I havent heard from them since Feb. & hes passed in early November.
