Some Nitty Gritty I didn't know when I wrote last night

I accidentally posted some erroneous details...since we learned today that our mortgage company is more underhanded and unethical than we thought.  When DH lost his job and we contacted them, they told us a "Loan modification" was a way to go that would allow us to be considered current on our mortgage...we would be paying a lower payment for 6 months...then a higher payment for 6 months (which would start in June). They said if things weren't better in June, we could re-apply for a loan modification to extend things.  We have a 30 yr fixed loan on a good interest rate, and this sounded like a great option.
So, all this time, we thought we were current on our mortgage.  This is what they told us, with the dire warning that if we were even one day late, they would fast-track foreclosure.
When we tried to find out how things could possibly move so swiftly, we discovered that they have been considering us (and reporting us) as in arrears since the modification!!!!!  So even though we had their assurances and we paid on time for our whole mortgage, they flat-out lied about the loan modification.
AND WORSE YET...while I thought they were just asking for the higher payment to be paid on the 9th or else...that is not the case!!  THEY DECIDED TO RESCIND OUR LOAN MODIFICATION, so they want every nickel that was supposed to be spread out over the next 6 months, PLUS our June payment by the 9th...OR WE ARE OUT. We have not calculated that, nor did they give us the exact amount, but it must be about $9500!!
I have called several of the places suggested to us and emailed a few others and it seems that we are in a bad position for a few reasons.  1) We have a fixed rate loan...a conservative product...because we made a wise choice, there is no help.   2) We don't qualify to refinance our house because DH is unemployed.  3) We have been classified as "in arrears" by the low-life mortgage company we have for 6 months!!
I will leave no stone unturned and I am SO SO SO GRATEFUL for your suggestions and encouragement. Keep them coming!!
Please pray for my sweet husband who seems to be breaking under the pressure of this last bit of news about our house.  He is especially crushed because of how Sophia talks about our "home sweet home" and how much she loves her bed and such.  She doesn't like to be gone long at all...always asks if she can go back to her home sweet home.  :-(   I know she will adjust to wherever we go...but I know it will be a knife in Jason's heart during the time she cries for her home...he is a sucker for our girls and it will be so hard for him.
Jason called a LOT of people about possible rentals and we just do not qualify for a place that 5 people could live (fire code and such). We had several people offer us rooms in their homes, which was so sweet, but we have a major problem... Sophia has HUGE allergies to gluten, casein & soy.  She would be covered in hives and have severe GI pain all the time!!  As many of you know, she lives in extreme pain all the time, we can't add to her pain.
I wrote to a wonderful family who runs a campground that we used to go to each summer and explained our situation.  The answer I got was so heart warming that I was full of joy!  They remember our family as "the nicest family that they've ever had" at their campground and said they would be willing to lease us a space there on a monthly basis.  We need to get a trailer, of course, but the campground is beautiful, immaculate, has a swimming pool, a huge field, bike trails, hiking trails and even some goats the girls love to feed.  I told Jason that, at least for the summer, we could just pretend we're camping and enjoy each other while he looks for work...of course I'll probably be stuck in bed...LOL
I know this sounds like a really embarrassing option, but we could make the trailer an allergy free spot for Sophia...and maybe the girls would have so much fun, they wouldn't notice too much?  Although the packing up part will just devastate Sophia.  She is a girl who plays with everything she has and LOVES her toys so much.  She pretends they are all real and have feelings.
Anyhow, sorry to go on...we never know what God has in store for us, but I feel good about preparing a worst-case-scenario option that we can adjust to.
Thank you ladies again...TRULY...FROM THE BOTTOM OF MY HEART!!!  I feel so blessed to have you!!  This is one of those ways that I feel God has filled the gap left by family in our lives.  :-)

My sweet sweet friend, my heart is so heavy for you right now. I have seen how many people love you here on DS and many people are praying for a miracle. Since we recently became friends on DS I didn\'t realize the pain your daughter is going through, I am so sorry. Is that her picture in your profile? Such a sweet girl. BTW your DH sounds like a major keeper, nothing more attractive than a man that is sensitive like he is.
Honey I really think there is more you can do about this housing situation. There are a lot of federal programs out there that can help you out. Your Mortgage Company sounds totally crooked, it pisses me off so MUCH! I am going to ask around tomorrow at work. I am in CA so I dont know if laws are different but I will ask some of the head Mortgage people I work with.
I am going to pray for you and your family tonight. You are going to make it through this. I swear if we lived closer I would totally help you out!
Much love to you, the girls and DH

I feel the same way... God has definitely filled the gap left by family.

A year after Symone was born, my first husband walked out to live with a young woman he met in a bar and had gotten pregnant. Since I did not work for Symone\'s first year of life due to the fact that everyone was afraid of her due to her cardiac history, I trusted that my Paralegal Husband was paying the mortgage... 2 days before Thanksgiving 2006 he walked out and moved in with his pregnant girlfriend. As he was walking out the door he handed me an envelope which was a foreclosure notice telling me that I had limited time to remain in my home.

All in all, I hated to leave but... I did not have a choice. After I\'d moved into the Apartment from Hell... I found out that there were organizations that could have helped me. I\'ll do a little research and see if they are also in your area.

I know how hard it is to uproot little ones and move into unfamiliar surroundings. Let\'s work on keeping Sophia in her home with all of her toys. I honestly wish Symone would play with her dolls. She has such beautiful ones and in the beginning she would say that she and Annaya were playing... Things haven\'t been the same since we were hit by the car on March 1st.

Well, I\'ve talked your ear off...
Peace and Blessings!!!
Hugs!

I am still sooo sorry for you. My son was the same way when we moved 2 weeks ago. It was heartbreaking enough for us, but he kept walking around, touching things, and crying. Even though we did eventually find a nice house to move into, it\'s in a different town. We\'ve tried to make things \"fun\" for him but last night as we were driving back from getting ice cream he broke down into tears and asked when we were going to get to \"go home.\" I didn\'t know what to tell him because I wanted to cry, too. We had trouble finding something large enough to accommodate all of us, as well as my office since I work from home. People wrote me and told me to sell all of our stuff, put my kids in the same bedroom, sleep int he living room,e tc. Those suggestions just made me feel worse, like we were being punished.

I really, REALLY hope things start looking up for you guys.

wells fargo?? sounds alot like the stuff they tried to pull over on us. except when we initially applied for the mod, they refused because eric was out of work, so we just plain didnt pay. once he started working again, they wouldnt do the mod unless we paid them 9500 up front. so we just let the house go, and made sure to get into a rental before the foreclosure was on our credit. i wonder tho, if you showed your mod contract to a real estate atty if they may be able to find a loophole, or even one of those \"fake signatures\" i hear so much about. ive heard lots of times of families facing foreclosure and they wind up getting the house for FREE because the bank did a sloppy job in their efforts to screw them.

Ive been wracking my brain for the past few days trying ot figure out a way to help. Im just throwng this out there but since your morgagelender was so unethical and down right lied to you cant you file some sort of injunction or complaint to halt forcloser proceedings until the matter has been looked into? They just cant do his. They just cant lie. I was in the kitchen yesterday and i heard something on tv about help but i couldnt writ down teh information in time. I will try t o find it out. This is just wrong. Short of kicking he tenants out of my house in Ga (which have considered) I wish I could do more. But I cant kick them out as they are great tenant and its not the christian thing to do. I wish I had money to give you. I live close to DC and I am a legal assistant. Both times i have cast out a pole to see about working I have gotton bites. I actully have a interview today. I know for what your husband does there is alot of work out here for that. I will continue to pray for you and your family and remain faithfull that God knows what he is doing. I pray he can cover you husband in a cloak of peace about this.

I was thinking about you this morning and I remember my SIL was about to have her power shut off because shew as in arrears (over $1200) and she got a doctor\'s note because of her daughter\'s asthma and they couldn\'t turn it off. I don\'t know if it would work in your situation but what getting doctor\'s letters for you and Sophia about how it is medically life threatening for either of you to move at this time. Also, I have seen on internet and on TV where foreclosures were halted when the home owner petitions the court for the mortgage company to produce loan paperwork where they actually signed. Because so many mortgages are sold and sold and sold again most mortgage companies have a hard time producing original documents. Doesn\'t solve the situation but does buy you a little time to figure out a better solution. Hoping and praying that something can be done. I would think going into court and explaining how this mortgage company lied and completely defrauded you would be enough to at least give you some time to figure out a solution. Ugh! My heart goes out to you and your family at this stressful time. XO :)

I don\'t know how comfortable you would be with this idea but I will throw it out there because I just saw something on our local station about a similar case. The family contacted the local tv station\'s consumer support. You know the ones who do the expose on bad cleaners etc. Well they were about to be evicted from their house because of a lot of bs from their mortgage company and they got 4 on your side on the case. They did a segment about them and basically shamed the mortgage company into doing the right thing. Just an idea.....

Thank you ladies for the ideas! We are following up with every one! We have hit MANY stone walls over the fact that we did a very conservative loan to begin with AND that my DH is unemployed (we don\'t qualify for a refinance or even modifications under many programs because of that). We do have a Fannie Mae loan, which was supposed to be very helpful in this situation...we\'ll see.

PLEASE KEEP THE IDEAS COMING!! I trust that God is working through you awesome ladies!! We just have to be diligent and keep pounding the pavement!

The media thing is something we are praying about. I don\'t want to sound fruity, but we have worked hard to make sure my family doesn\'t know that I am pregnant because my mom is proficient at wishing harm on people and then it happens...she boasts about how she is able to curse people. She was so happy and hateful to hear that our baby died last Fall, that I am scared to have her find out we are expecting another baby. They are local, so if we go to the media, they will OBVIOUSLY find out. That may sound very silly, but I worry about this baby and am doing everything I can. My mom is a very evil woman and scares the living crud out of me. I know God is more powerful than anything she can do!!...But I have also learned that in spiritual confrontations it helps to know what you are fighting against.

oh sweetie, i have been thinking about u all afternoon yesterday and all this morning, I wish there was something i could do! i wish u were down here or could get down here, i would turn my home friggen soy free gluten free (bret-free lol) just for sophia!! u are such a sweet and strong person and you and your dh really dont deserve all this bad crap coming your way! does your church have any resources maybe u could look into? WE have a thing in Louisiana called section 8 housing? its housing assistance for people going through a rough time? i havent read everyone elses comments but have you considered this? i know it will be hard for the girls but im sure as long as u make it \"fun\" for sophia then she will love it. When i left my sons bio dad i was so scared jeremy would be upset, and he was. he missed his room among other things, we got into an apartment that had just been built but it was based off your income, so the apartments were brand new and looked great! and we were like the first ones living there so it was even nicer! ... i told jeremy we were moving to a \"castle\" and it stuck! it made it easier for him and i swear he called it a castle until he was 4 lol...* big hugs * i know God will find a way to work all this out for you, and dont forget just because he doesnt answer your prayers the way u think he should or the way u want him to doesnt mean he isnt answering in a way that is best for you. thinking and praying for u !

oh my goodness! I\'m so sorry I haven\'t been on DS for the last 2 weeks. I don\'t have any helpful info to add, but I am praying for you. Since I am just a few towns over, if you need anything, please call me. 253-332-4747. I am praying you will be able to stay in your home, especially for Sophia and your sake. And I am praying for strength, comfort, peace, and answers straight from the Lord for your husband. Our house is 700 square feet, no spare rooms...but if you need a place temporarily, I\'m sure we could accomodate your family somehow. We could always move Jonathan into our room and give you his. I know it\'s really small, but it\'s a room. I could make our home gluten and soy free if you directed me how. Does having packaged food in your pantry bother Sophia? My husband\'s job is really uncertain at this point and I am wondering myself how we\'d make it even for a few months without income. You have such faith. I know that God is \"Jehovah-Jirah\" Lord Provider and He has promised to provide. I\'m thinking of Matthew where He points to the birds of the air and the lilies of the field...how much more precious are we. Your family is so very precious. I am hoping and praying you can stay in your house, and that God will provide a way. Whatever happens, if you need any help, please call on me, ok? Your friend, Rachel

You ladies are so sweet, that it always amazes me!! How would I live without DS?!?! My treasures in life have become: God, Husband, Children, DS ladies, Real World Friends. LOL That is funny, but true...I feel MORE love and support here than anywhere outside of my husband and kids!

Thank you so much for your encouragement through this. Honestly just feeling like people CARE about us shows me God\'s love in such a beautiful way!!

I think I was naive about how Marissa would react to the trailer/camping idea. LOL She is 13 and, as sweet as she is, she FLIPPED out. Flipped out sweetly...with quiet horror...said she can\'t imagine it and it would be such an awful way to live..and she could never have friends over. I told her that it is just an EARTHLY answer that came to us, but maybe God has bigger plans! Poor girl. It truly would be sad and hard for all of us, but we will do whatever God leads us to do.

I think I may have explained the dilemma about what job Jason may get... if he is lucky enough to get a low or medium income position, we lose our medical coverage through the state, so we will probably get ASTRONOMICAL medical bills because of Sophia again. As I think I\'ve shared, on our AWESOME medical insurance we had out of pocket in excess of $4,000/mo...so deduct that OR MORE from whatever he might make...depending on the insurance plan they offer! For us $50,000 a year in her medical was...DEVASTATING.

Shay, Thank you for the sweet comment! We don\'t qualify for Section 8 in our area because of Jason\'s unemployment. (and comically we don\'t qualify for help on our mortgage because he\'s not working)...lol Can\'t win for losing!!

Achingheartmama, no one would want to go Gluten Free for the heck of it...trust me!! :-) I think you guys would all want to check into Western State Mental Hospital if we descended upon you! Sophia (with her bouts of pain) would drive anyone nuts!! That is so very very sweet of you though!! It is good to know there is an option out there...although I TRULY believe what you said...God is our provider!! It is a miracle we still have a roof over our heads...utilities and Internet! (Marissa does online school, so we need it!)

We know His plans for us are to PROSPER us..not to hurt us, and I know He has carried us through this journey every step of the way and will NOT abandon us!! :-)
