Latest court doc

How can they put out and out lies on a court document?  AND line up witnesses who will testify that I was abusive????  Gee, after all the raging I put up with???  I have never been accused of being anything except being TOO nice!  And how I was only after his money when I wasn't on any bank account and never spent a dime that wasn't earned by ME????  I am in shock.   Then my lawyer tells me to review my interrogatories to refresh my memory on what I wrote.  Gee, I wrote the TRUTH so I don't have to remember??????  What happened to the truth the whole truth and nothing but the truth so help you God?

I feel for you, but know i am behind you all the way. I am finding that as the legal stuff starts that they will almost say and do anything to insure their future is better. My husband is now even threatening to ask for alimony from me! After everything I have done for him! It is truely sad. But it just shows that we are doing the right thing.

Hang in there. It will be tough, but you get to know in your heart what the truth is and God will also know. Karma is a real bitch.

Can you demand lie detector tests to be taken? Maybe you could get on the Steve Wilkos Show - he does lie detector tests all the time. My husband hasn\'t lived with me since 1998 and he complains about not seeing his 13 year old daughter as much as he\'d like -he has every opportunity but won\'t hop on a bus to do that. He expects to drive her to his apartment and pick her up. She doesn\'t want to visit him as he\'s boring and offers her nothing except baby talk and umpteen questions. I told him as soon as he gets his lazy butt on a bus to come over, he can stay for awhile and then leave again. He hates the bus. So? What\'s more important to you? Because he is disabled he has managed to get on the \"Marijuana Initiative\" and I do not want her around that stuff, or his cigarette smoke. She\'s entitled to good health for cripes sake. I am responsible for her health and such and those vices are just not going to fly with me, or her. She doesn\'t want to be around either of those health hazards. Smart girl. I can\'t imagine a judge enforcing her to subject herself to that. He seems to think not smoking in her presence is the answer. What about the smell of his apartment, permeated with those smells? Get real.

I keep telling myself that just because he SAYS these witnesses will say these things--doesn\'t mean they will lie for him. I knew his attorney was a scum bag from the beginning so this shouldn\'t surprise me. Just a kick in the stomach to see a 4 page document that doesn\'t have a sentence of truth on it. If I was really this horrible of a person wouldn\'t someone have filled me in along the way? My lawyer insists that the judge doesn\'t have the time to read every piece of paper. If he did, there are enough typos to make the man drink--and the stbx\'s story changed with every set of documents.

Oh, Shorty, I am an ex-family law attorney. I was treated just like you in my divorce and thought I could do something about it for others in my own law practice. No, the truth has long since been replaced by theater in our court system. Can you get some witnesses who will say they see your personality as passive and maybe some who know you have experienced verbal abuse? If you can, then the judge has a classic \"he said, she said\" situation - the witnesses tend to cancel one another out. Also, the usual attack when a woman alleges abuse is to characterize her as crazy, overly sensitive, vindictive or making it up because she doesn\'t have any real argument to present to the court. Try flipping that one on your accuser. He\'s mentally ill (hey, it\'s your opinion, so you don\'t have to prove anything--although, if he was ever a little down about something, you can say it was depression). He\'s over reacting to times when you were only looking out for his best interest and he just didn\'t want to hear the truth or some such BS. Or he is just getting back at you for whatever he is currently ticked off about and he is intent on \"punishing you\" by making up lies. And finally, you can say he doesn\'t have a leg to stand on in court, you are clearly the one in the right, and as proof that he knows that, too, point out that he is making up abuse stories. That\'s the sort of bull I usually heard in court (I tended to represent the one who was truly being abused and crucified for saying so.) The judge will often listen to this horse manure in opposition to an abuse allegation. Give it a shot. Also, be sure that your attorney is in thick with the judge, if at all possible. It REALLY makes a difference who goes hunting, golfing, or drinking together with the judge. And above all, ask to see any court order before it goes to the judge -- the usual practice is for one of the attorneys to write up the court order for the judge to sign. It is astounding how many times the write up is nothing like the actual agreement. Catch this before the judge signs by telling your lawyer you want to see any draft orders before the judge sees it. The lawyer may not like it - but stick to your guns on this one. I hope some of this helps. My heart truly goes out to you. I was burned at the stake at my divorce b/c the attorney and the judge had a personal relationship (very personal). Hang in there!

From the onset, my attorney put in a request for a different judge for the very reason you mentioned. We don\'t know much about the guy who was assigned. He lives 200 miles away. I think I have the very best witnesses possible--though no one ever SAW what went on between us. I suspect with the meds and the level of rage he is in at this point in time--he might just prove my point--though he does have drugs that help control some of it. Thanks for the advice.
