I know this is silly, but just have to tell ya....
Got home during my lunch hour yesterday and realized what putting in that privacy fence is gonna entail, lol. He's been encroaching on my property since the day we moved in - before actually - AND, if he follows law, he's gonna have to get a survey done, then put it in where it will cut off his access to the back yard from my side of his house, AND he'll have to tear out a sidewalk, AND build a door in his garage so he can use his lawn mower without going all the way around his house, lol. OR, if I'm generous, I'll SELL? a 1 foot strip along the property line that will give him room to put it in more easily.... I'm thinking.... NOT. And I know this is because he hates seeing (or not seeing around) the sunflowers.... I'm definitely gonna grow them again next year, lol. Closer to the house so he can't cut them, and so I can enjoy them better myself because since he lives East of me, they all look his way as if to mock him - even the ones he cut are growing new heads, lol.

Careful with someone encroaching on your property. Many states have adverse possession laws, where after certain number of years that property then becomes theirs. Most common way people do it is by fences and other property line barriers.

Won\'t matter to me anyways - while the fence is important no matter where it\'s placed, it\'s the no contact that I\'m focused on most - and even if it doesn\'t get put in the order, my attorney says I still have the option to have the police involved and they are only 4 blocks away, lol. This entire past week, it\'s been silent... I\'m loving it!
I was thinking like Edgar3420 be very careful about what he has already been using. Unless you research this and take full precautions he could legally take all the property to be his! and never pay you a dime! Better to just handle it legally and correctly. If your property line is in the middle of his (current) part of the yard. Find out what you have to do to make him put privacy fence on \"his\" side of the property line! Another thing about fences if he pays for the whole thing,(which is what you want and the judge said to do)then he has to have some access to paint and maintain is property ie the fence. Probably won\'t want to bother, but this could come back to haunt you. More reason to make sure of the location of the fence before it is built! Might cost you some more time and stress, but better now and have it done with.

You have been given some good advice. I\'m so happy that you have your roar back.I\'m glad you aren\'t going to sell him that 1 foot stretch of land. You did good and I can tell you are proud of yourself as you should be.
I\'m not real certain about this, but it\'s my understanding that a fence has to be so far WITHIN the actual boundary of the property line. This gives the fence-owner an \"easement\" on the outside of the fence to maintain it. Check with your County for these regulations. I know that most of my fences are 18\" from the actual boundary of my property. The ones that run along the wooded sides are probably less than 18\" inches, but since it\'s all woods and the adjoining property owner is way up over the hill from me, nobody has ever said a word about it. I rebuilt new fence right along the old fence ines -- but again, my neighbors are pretty far away and out of sight.
I hope this stops being a focus in your life. Your home is your \'castle\' and should be a place where you can re-charge and find peace. My ex had fights with a few previous neighbours and I was too stupid to see the pattern and realize that it was HIM that was the common denomnator!

Ooo reading my mind, lol. Yes there\'s Squatter\'s Rights here - BUT, he has to be paying taxes on it (and he\'s not, I AM). Order says he has to install the fence ALONG the current fence. So if he puts it in with just a basic fence, posts will be on my small stretch - which is fine. But if he wants the fancy one that is like the one in his back yard, he\'s gonna have to move in 2 to 3 feet onto his property just to have access to put it in - because DAMN if I\'m going to let him inside my gate! :) I still win, lol.
