divorce dragging on
After mediation meeting, ex says he doesn't want the agreemen we agreed on. Wants to fire his attorney and both use mine. I have been gone 18 mo and he has paid me temp support for 2 months. Does anyone know if he ca back out of this agreement at his whim ? It was signed and notarized by both of us and lawyers. I have been married to him for 56 years. He doesn't want to give me half the house. Wants to keep it for adult children's inheritance. Help me understand the system please!

You need to have your own Atty. Your stbx is dragging his feet for his own selfish reasons. Ask your Atty about the signed notarized agreement. Research the divorce laws for your state. I\'m sure your Atty has explained them to you. Your health has gotten worse. You need to push to get this divorce so you have alimony coming to you.
Yes you need your own attorney. Sounds like he does not want to pay one, that is his problem. In my state if the agreement is broken you can file a motion & charge them with contempt. It is a legal document & is to be taken seriously.

Michigan is an equitable division state. In an equitable division state, each spouse owns the income he or she earns during the marriage, and also has the right to manage any property that\'s in his or her name alone. But at divorce, whose name is on what property isn\'t the only deciding factor. Instead, the judge will divide marital property in a way that the judge considers fair but won\'t necessarily be exactly equal. I gave this information to a friend in Michigan. You need your own attorney. If there was an agreement, then he has to honour it. The judges do not like people wasting their precious time for things that have been resolved. He could lose big time.
