Eight months wasn't that long, depending on your state & the number of cases on the list.
Yes get the appeals going. Keep your doctor appointments! Go through your life history, document every hospitalization, every treatment/therapy, even if it seems unrelated all the way back to childhood.
You may be applying for a lung condition, you may be approved because of a bundle of issues - mental health, life altering experiences, a bad back plus the lung. Do you see?
Wishing you the very best and especially, keep plugging away & try to remain positive.
Does your attorney think it is worth appealing to the Appeals Council ? What is your Date Last Insured ? Did you tell your doctors the details of how your impairments affect your ability to perform Activities Of Daily Living ? Did you get copies of your medical record and read them to verify your doctor wrote this info down ? And there were no errors in your medical records ? Did you fill out an updated Function Report before your hearing ?
If you do not qualify for SSDI and Medicare. You may or may not qualify for SSI and Medicaid... SSI and Medicaid are welfare programs. You must have little to no income and resources to qualify for SSI and Medicaid. If you are married, your spouses income and resources are counted. If you do not qualify for food stamps or other government assistance programs. It is highly doubtful you will qualify for SSI.
If your Date Last Insured has not passed you can file a new SSDI application if you do not appeal the hearing decision.. If you appeal your hearing decision you cannot file a new SSDI application until/unless you are at the Federal Level. You will have to wait for the Appeals Council to make a decision. If your Date Last Insured has passed and if your meet SSI financial criteria you can file an SSI application while you wait on the decision from the Appeal Council.
If you appeal to the Appeals Council. Evidence dated after the date the ALJ made the decision is not considered. But, it is best to submit it in case you appeal to the federal level. It can take 18-24 months or longer to know if the Appeals Council will remand your case back to the ALJ. There are no guarantees of approval with a remand.
You need to talk to your attorney about what to do next. If you file a new SSDI application, you will lose any back pay you might be eligible for if you are approved on appeal.
