That is pretty much standard language in a separation or interim (pre-divorce) agreement. Don't overthink it. All you are doing is saying the marriage is over and both of you are free to do as you wish. No worries about accusations of immoral behavior and no fear of being accused of adultery (because technically, until you are final divorced, you are still married). xoxo

That line made me laugh. If they did not honour their marriage before, are they going to stop cheating until they are divorced. It is more for the person that was given a sucker punch than the one that caused all this journey from hell and back.

Lol, knuckle. Thankfully, adultery was not present in our marriage. There were, however, plenty of other things that weren't present either and that's why we're separating, lol.

Here's another part of the Agreement re: modification. "Both parties acknowledge that under __ law, all matters addressed herein shall be non-modifiable, including but not limited to all provisions related to alimony, spousal support and equitable division." I want this, right?

that I cannot help you with. In Canada the laws are different. But go for everything that you need for now and the future.

You absolutely BETCHA you want that non-modifiable clause in the agreement. The appropriate language may vary from state to state, but if I get a minute, I will send you the language from MINE via Private Message. I remember it says something about "cannot be modified or rescinded by the court."

Yes you want that clause and one that states SC retains jurisdiction over your divorce and no other state can modify that decree. That's the jist of what mine said and that it could only be changed if we both agreed in writing and approved by the court. The ex tried to change our agreement twice and then just quit paying me. SC upheld our decree twice and the ex had to pay. The last time they agreed to our new agreement giving me the farm, the alimony he owed me and all my atty fees paid.

Alright, this is going to send you all over the edge…but bear with me...I think I'm onto something here…just like with the car…which, thankfully, is now sitting in my driveway. Stbx and I worked that out without fireworks via email. Two days later, I had the car. So, now I have the Agreement in hand. I have read it all now. One thing I cannot go along with is that stbx has fully disclosed his finances. He just hasn't. Even the financial planner stated that. Stbx and I seem to be getting along fine at the moment, coordinating plans to sell our house, getting some things done prior to listing, etc. He's been asking if I had received the Agreement. I told him that I had and finally read it this morning. Since the car negotiation went so well with him, I am thinking about letting him review the Agreement. It is only a draft and it's not in its final form yet. But, is there any harm in discussing it with him before the draft is finished and without an attorney? I fully intend to involve her again to review what we've come up with but can't we do some of the negotiations on our own just to save money? What do ya'll think?

Also, I told him that if he wanted to discuss the Agreement draft with me, he needed to finish providing his financial information since Jan., which he hasn't done. Once he provides that, we can see about discussing the draft.

If you do not feel that he has made a full and truthful disclosure of your finances, then there is no way you can move forward to a financial settlement yet.

AT this juncture, I think I would finalize the Agreement with YOUR attorney and then let it be sent to your stbx's attorney. I would not discuss it with him. Period. Let the attorneys hammer out the details.
