I want to start something for those of us that were married for a long long time. I think that we face a little different issues than those who were dating for a few years or even married for shorter period of time. Being married for so long we have older children some have grandkids dealing with teenagers and their reaction to the divorice empty nesters dating after 40...

Ok guys need your input. Just found out that the temp support I was granted through the court from Sept. 2012 to june 2013 was completely erased. X ended up owing me $5564 in arrears but when the divorce went through they erased the temp. So the arrearage got erased too. Normal practice i guess. But my question is----if the courts granted it and he didn't pay it am I not still entitled to it?

Before you say it, I already put call into to my attorney. No response yet. They said at csea the court may reenact it if I file papers. But what will this cost me? More money! I know the atty charges $90 per hour. So a 15 minute question answer period will be $15.00 lol

Know I shouldn't wish anyone evil. I know that karma will happen sooner or later. I know what goes around comes around. I know it was worth it all to get rid of that disease carrying, cheating, lying, sick piece of trash.But, damn, let me get some little satisfaction out of all this! i got the bills. he pays support forever. but I want just one little itty bitty, teeny weeny thing to happen to him that will make may day. JUST ONE THING!!!!!

It is not right, but you may have agreed to it or your lawyer did.. all you can do contact your lawyer, and find out what is what. Do you have a final copy of your divorce decree that says Finding of Facts and Judgement? This is not normal practice, but all kinds of lawyers cut all kinds of corners in divorce.. and did you trade off an asset so he did not have to pay back temp support that he did not pay? I have no idea what you mean that the court erased the temp support? Erased is not in language, but if you mean when you divorced, temp support ended and was replaced with alimony or maintenance. You said he pays support forever. It should have been addressed in your final divorce hearing. It may have been waived, and you should have had to agree or been asked..

If you have to spend some money to get this 5500 it may be worth it. That is not normal practice, there is more to this. Best of luck.. but find out. Read your divorce decree first. HUGS

Ok "erased" isn't right. But the support bureau said they "waived" the arrears when divorce was final since first one was "temporary". Never traded off anything. We both got our cars. We both have place to live. He acquired his while we were still married but paying on it now. Mine is paid off. That's y I got stuck with the line if credit loan. Support has no cap on when done. Hence I mean forever (or he dies or I remarry)

Then he got it waived... and good news you have lifetime alimony. I hope if he did not pay the temp support or was in arrears, that is is set up through his employer as a garnishment, so that it doesn't go into arrears in alimony or maintenance. It is a court order. It sounds like you do go through the state, if you talked to a support bureau.

None of us can collect alimony or maintenance if we remarry. Although most divorce law is state mandated, this is in every state in the USA. The Feds... If he dies, I asked for and got him to carry a term life policy in my name, to cover any alimony that is due to me for x amount of years that could be left on our settlement. It decreases by the yearly amount each year.. so I would only get what is due to me. Some lawyer think of doing that, some do not want to bother. Best to you nohapppy, but if that is what the support bureau said, though they have nothing to do it with it, you may want to call or email your lawyer and find out if it is still collectible and how to go after it. 5500 dollars, may be worth a couple hundred to get it. When the divorce was final you lost your temp support to be replaced by your alimony. Call your lawyer and see what he says. You might still be able to collect the temp support he didn't pay you. If csea said you might be able to reinstate it maybe your atty. can tell you more. I wish my atty. had been that cheap. At $90.00 an hour it might pay to check into this.

Yea I have a call in and am waiting for response. And yes ms terey his employer has the garnishment. I have already promised him that if not paid I will pursue. No messing around. And I was adamant that it go thru the state not direct to me. I am hoping that it goes back in effect for arrears. Lot to give up on for me. Just shame when court knew he defied so many parts if court order they did nothing. That ticked me off. But it's all done so if his employer follows their court order it's all good. Will see what lawyer says.

hang in there my friend. Something is not right. If he owes you support, then even if a permanent order is issued, the delinquent support has to be paid. Whether he likes it or not. Go for it. Hook, line and sinker

Ok atty called back. Yes I am entitled to the arrearage. No it wasn't defined in papers. BUT it also didn't say in papers that it was to be waived. So judge told her to call his Atty and send in proper paperwork and judge will sign. Finally!! A little peace of mind.
