I think that we face a little different issues than those who were dating for a few years or even married for shorter period of time. Being married for so long we have older children some have grandkids dealing with teenagers and their reaction to the divorice empty nesters dating after 40...

A year now past the finalization of my divorce the X has stopped meeting his financial responsibilities per the QDRO. So, he lives in another state and it is very lax in any recourse I have, per my attorney there. I had thought I was doing o.k. and finally getting my own money issues in order and now this. Due to co-signed items I am now being hassled by creditors. The X is now unemployed. It just bites that I'm stuck with what are "his responsibilities". I'm just looking for advice on how to keep a level head and move forward. I can meet most of the creditor demands for now but it makes me angry that I am being put in this position.

Keep track of what you pay and keep the receipts. If he does get a job, hit with a reimbursement motion. If he has any assets, you can levy on them.

The QDRO has nothing to do with his financial responsibilities, it is the division of any retirement and investment assets that you had in the marriage that was divided at the time of the divorce. I had one, it stands for Qualified Domestic Relation Order and it take some time to get it all after a divorce. It is the court order to assets that you have, as in my exes pension, 401k, our personal Fidelity Investment account, and or any invested assets we had, in CD's. You may be using the wrong term, but I do get what you are saying... and I am so sorry.

Your divorce decree should have spelled out who and how the debt is paid, for unfortunately debt is part of what gets divided in divorce along with the assets. IF you are being hassled by creditors, and you were part of the debt, they unfortunately have the right to come after you, if he stops paying. You can state you were divorced, and provide proof to some and they will stop, but others if you were on the card or a loan, they will continue to harass you. They can garnish your wages. One thing that you can do is provide the information where he is, his address, current phone number and have the creditors harass him.

I have heard it a millions times, it is his debt, but I was on the card or loan. he bought toys or a new car, now they are after me. Or I closed out the ccard, but I can't cancel it until I pay it off. It is all a pain in the ass. For anyone with assets, equity or income, you can get stuck paying it. My heart goes out to you, and I hope this helps. You also may ask your attorney if you can hire a new lawyer that deals with consumer debt and divorce.. but that costs too. HUGS
