Each state has different bankruptcy laws. You can only file chapter 7 if you make less than a certain amount. If you can file chapter 7 it's easier. Chapter 13 requires you to pay a percentage back and you may have to go back in front of the judge to have the percentage changed.
If you could file chapter 7, then by all means do that. Chapter 7 just clears your slate and wipes it clean....well with a bankruptcy on your record. So many good people have filed and it doesn't take too long to rebuild your credit up again. It can be depressing having to file but if you use it as a learning tool, if can definitely help you get yourself financially together.

Sorry that I have no knowledge of bankruptcy and it may differ from state to state anyway. You should check with an attorney who SPECIALIZES in this. Also, are you divorced or just in the process? That would have some bearing on how to file.

Hi, I am in the process of divorce, my stbx is still in the house and falling behind on payments, if I file now it will be better if they forclose, the lawyer said the auction price and what's owed will fall us to pay the difference but if I file it will clear me of that balance and they could only go after her.

No experience with bankruptcy here, thankfully, but want to say I'm sorry you're going through this. I know it can be a good tool to get out from under debt and rebuild your life. Hope it works for you.

I would go 7 if you can, the bankruptcy is dismissed much quicker, chapter 13 takes 3 years I believe. If it's inevitable losing the house I would go that route. But if u do go 13 you can switch to a 7 later but not the other way around. But considering your circumstance 7 sounds better...just my 2 cents
