Tomorrow, I am meeting with my attorney to review the first draft of the Agreement. (Yes, we finally have something in writing! It's been 8 months since the stbx moved out and we're just now getting our Agreement together!) I have a million questions. There are many things that have not been discussed. My question is this.
How many meetings did you have with your attorney to work on your Agreement and how long did this part of the process take? I so want to get through this quickly but I know that my stbx is not going to easily agree to these things. We had so much success resolving the car issue that we thought we could sit down and go over this first draft together and try to resolve as much as possible without the attorneys to save money. But then, the stbx changed his mind and said no. That he thought we wouldn't be able to get through this without the help of the court! Did he mean litigation? God, I hope not. Was he just bluffing and trying to scare me?

I met with my attorney for 2 straight days since Im not in the same state. First dayswas about 6 hrs and second day about 2hrs to go over things and sign paperwork. My stbx didnt agree on anything and we were scheduled for trial. Luckily stbx agreed that morning on everything so we didnt need to go to trial.

Okay your stbx has made it 8 months without paying you temp support. He only has 4 more months and the divorce will be final. I bet at the 12 month timeframe he suddenly gets in a hurry to get the divorce over. You don't need the settlement agreement in writing to ask for temp support in SC

trisha - I noticed in the Agreement that the attorney is asking that he pay the $13,000 VISA balance as temp support. When I meet with her tomorrow, I'll ask if we can go ahead and file for that separately. I am really in need of it now and who knows how long this process will go on. So, thanks for letting me know how that works in SC. Is there a website that outlines the other rights in SC? Really would like to review that before I go in tomorrow.

proudnana - thanks for letting me know how long you worked with your attorney. this is all such important stuff…just can't imagine us getting through it all in one meeting.

Just Google divorce in SC. You are going to only get basic info and try googling temp support in SC.

I had the ex served in early May and by the end of May we were in court asking for temp support. I was a stay at home mom and had little work history. I came out of this okay but I work really hard to support myself and that's all I wanted. The chance to make a life for myself on this farm.

The 13,000 is for the last 8 months. Your atty needs to ask for temp alimony from that payment until the divorce is final. The 13,000 has to be repaid so what will you live on when you pay that credit card off? You will be charging on a credit card again and going in the hole with debt when the divorce is final.

Happy to report that I had a GREAT meeting w/attorney this morning. Had all my questions answered thoroughly and to my satisfaction. I feel so much better.

As far as the temp support goes, that was the first thing I asked about. Since my attorney was sending over the first draft of the Agreement to stbx's attorney today, and the temp support is addressed in the Agreement, she wanted to wait for their response to see how to proceed. I listed the bills I had coming up and she seemed to understand what I was facing. She said that alimony begins as soon as the Agreement is finalized, which may be very soon.
