Billing Question? Pdoc vs Therapist

I have a billing question, that I hope someone can answer.
My husband is seeing a therapist in a Pdoc's (Psychiatrist's) office. For billing, they are billing my husband's therapy sessions under his Pdoc's name, NOT his therapist's name. Thus, they are getting paid more and our co-pay is higher too.
Is this legal??
They are also harassing us for money owed when one of their therapist's was out of network, which she was supposed to be getting in-network status...and he saw her from 4/08 to 11/08 and he didn't know she was out of network for all of those visits. Insurance sent us a check made out to us, we didn't know it belonged to our Pdoc's office...we cashed it...now they're on our tails to pay $1100 by Friday, or they will discharge us from the practice. We don't have that money and they refuse to set up a payment plan. We've seen this Doc for 2 years now..this is insane!
The last time I used an out-of-network provider they accepted my in-network benefit and verbally told me I'd be getting a check from my insurance company and to call them when I got it and sign it over to them, they gave me their address to send it to. They even had me sign something noting they were out-of-network but accept my in-network benefit and sign about getting the check to them too!
I/We didn't get anything told to us verbally or in writing from this Pdoc's office about getting a check in the mail.
Please help answer my question!

I think I would talk to my insurance company about them charging you psychiatrist rates for a therapist..... they might be interested in knowing that..... If it is against policy they really couldn't force a payment from you while the "correct billing" was being worked out.....
