On 6th January 2011 the Interim Orders Panel, GMC, made the decision to lift the suspension of Dr Myhill's GMC registration and to restore Dr Myhill's licence to practise medicine. The Panel again placed a small number of procedural conditions on Dr Myhill's registration.

GMC removes suspension!

In a stunning turn around at the IOP Hearing today, the GMC has restored Dr Myhill's licence to practise, including the right to prescribe, but have imposed conditions which are largely cosmetic and procedural.
Dr Myhill will now be able to practice again as a doctor.
For the first time the GMC has acknowledged the substantial support from colleagues and members of the public and has accepted that no patient had been harmed or put at risk.
The GMC determination was received late this evening and Sarah wishes to consider it at length in the morning. The transcript is now available and can be downloaded here.

THE SANCTIONS AND WHAT THEY MEAN FOR DR MYHILL AND HER PATIENTS
Having carefully studied the terms and conditions of the determination today, Dr Myhill feels that she is now able to carry out about 95% of her normal work.
However, there are difficulties in using B12 and magnesium by injection. There might be alternative preparations available but Sarah does not feel the short-term gain from using them outweighs the risk to her licence at this stage. The High Court hearing should take place later this month and Sarah could have her licence restored in full.
What is apparent is that the sanctions applied yesterday specifically target ME/CFS patients more than any other group Sarah treats. This may seem unfair, but as we move towards the High Court hearing we need to remain buoyant and optimistic - after all we did not expect the GMC to overturn its own ruling despite common sense and the law indicating that it should.

Craig wasa member here and was someone who hkept us all up to date with the Myhill case before the GMC.
Basically Sarah being the practice owner took the administrative wrap for a breakdown in coms between another Dr she employsed's. One of his patients (who I think was also a doctor) made a complaint about some infomation that was available on Dr Myhills wabsite. The thing was the infomation on Dr Myhills website was never medical advice it was informative and educational only hence Dr Myhills amendments to her front page "Welcome to my website! - and the links to " How this website works " and " When not to use this website " so that people including those who want to go off on their own tangent and not consult Dr Myhill have some clearly defined limits of how to apply the infomation found there.
I think Sarah is clearly of the oppinion that what doesn't kill you makes you stronger.
Sadly in our world excellance and people who make a name for themselves with ground breaking research like

often find themselves on the receiving end of administrative procedures directed by Governing Bodies due to plaintifs who have gone off half cocked.
Thankfully Sarah is practicing again on a full liscance.

Just to update and clarify:
There were essentially 2 complainants
- A patient had self referred to Sarah and Sarah recommended that that patient's GPs prescribe B12 and Mg - the GP practice complained about this
-a (medically) unqualified person complained about parts of Sarah's website.

Where are we now?
-After initially removing Sarah's right to prescribe, the GMC have now reinstated that right.
-There are 2 sorts of hearings that the GMC has -
Interim Orders Panels, of which we have had a number so far - these do not consider the facts of the case but look at what they perceive as danger and put on restrictions accordingly
Fitness to Practise hearings where a proper determination is made based on the facts.
Sarah is due to have a Fitness to Practise hearing, at least before October this year (GMC has to call an FTP within 18 months of the initial IOP). This has been going on about a year now and there have been previous cases going back years more, all of which closed with no case to answer
In addition, we intend to take the GMC to the High Court for amongst other things, what we believe are Human Rights Act breaches.
I have referred the GMC to the Equality and Human Rights Commission, for reasons I am not allowed to publicise at this time and the EHRC are investigating.
I have referred GMC to Charities Commission for certain potential Charities Act violations.
The Information Commissioner is reviewing GMC non compliance with Data Protection legislation.
There are other things going on too.

CONCERNS ABOUT THE SREEENING OF COMPLAINTS AT THE GENERAL MEDICAL COUNCIL (GMC)
I am writing to you because of concerns I have regarding the above.
The GMC have been investigating certain complaints against Dr Sarah Myhill for over a year now without coming to a decided conclusion about her fitness to practise. I am declaring an interest to you that I am supporter of Dr Myhill. When the GMC investigations were first made public, thousands of patients and supporters wrote in her defence to the GMC. A Face Book group with over 2500 members is still very active and an online petition attracted thousands of signatures in her favour.
I feel the GMC have treated Dr Myhill unfairly throughout this whole process and I would like to cite just one example of the slapdash manner in which she has been treated.
At a recent Interim Orders Panel, the GMC lodged a complaint against Dr Myhill concerning her acting as a midwife, a medical practice which they considered put Dr Myhill outwith her permitted, and at that time, restricted medical licence.
The complaint was made anonymously but included a weblink which was as follows:

You will notice that that there is a link near to the bottom of the webpage and if you care to click on the link you will see that in fact Dr Myhill delivered some rather fine piglets! I think I am right in saying that the GMCs regulatory powers do not extend to the safe delivery of porcine offspring but I wait to be corrected.
My concern is that the GMC did not follow its own procedures for checking that complaints are at least worthy of commencing an investigation. The following wording is taken from

At an early stage we will decide whether there are issues which we need to investigate further, and if so, what form the investigation should take.
It is fairly self evident, I would contend, that not one single officer at the GMC clicked on the mentioned weblink and saw the fetching piglets in all their glory. This is a very serious issue because if the GMC can accept complaints such as these then what other spurious complaints are being accepted prima facie by their officers?
I would be most grateful if you could contact, Mr Paul Philip of the GMC and ask for his opinions on this sorry tale. In particular,
1--What if any procedures did the GMC follow in bringing to a full session of an Interim Orders Panel Hearing this complaint against Dr Myhill about her delivery of piglets?
2Is Mr Philip satisfied that the GMC followed proper procedures in this particular complaint?
3Have any steps been taken internally at the GMC to ensure that such ridiculous charges are never brought before an IOP Hearing again?
