OK, here's the deal ... my SPINELESS husband (via his atty that mommy & daddy paid for) sent over his "settlement offer" which they consider to be "more then fair". Of course he wants me to take ALL the debt on our house, which is worth 30-40K less then what we owe, plus all credit card debt in my name which he helped me run up ... no surprise there, but the real pisser for me is he wants a $6000 payment from me (equalization pymt, or some CRAP). Here's my Q; Do any of you know, when a dollar amount is suggested I assume the opposing party expects you to counter, but do we know by what percentage? I'm thinking I may offer $3000/ or half? Any opinions? If we go to court I'll have to pay an atty at least a $3000 retainer and even if the judge rules that my spineless scantless ex should accept half our debt, it will only be a judgment on paper and I'd never see a dime cause he spends all his $ on pot. When I met him, my debt was $5k, I'm now looking at 230K (including the house) and he thinks he should walk away scot free PLUS get $6000 from me? And I've been out of work since Jan 2006! --Your thoughts? Yes, I know I'm a fool...
