Please help if you can-- I want to get this guy back for at least something
We bought a house together 08/06- I sunk almost 10k into it - remodeling etc.. and in 10/06 I left - he put a restraining on me where I could not enter w/out his permission (for no reason) and he wanted to continue paying the note--- I was the Primary on the note! Well - he continued to pay late everyone month-- in May we went to mediation and he would not offer me a buyout for the house at all - not one flipping dime-- my choice was to walk away -- or go to court and be tied to the note for the next 30 years.. I walked away but he had to refi- in his name within 30 days of the final decree - which his did.. NOW- I get a check in the mail from the old mortgage co-- its an refund of the escrow account.. I have told him about this because it is payable to both of us-- He says I can have what I pad in it 3 mths. worth and he gets the rest (because he needs the $$) or he takes me to small claims court..I believe we should split. and just another FYI he is selling the house and adding 100k to the price .. Do I have a right to this or not..

cos take your chance in small claims court if you can get at least half... what you got to loose?... let him take you to court.. let him pay for it too.
He owed me a similar amount of money on another matter. I requested that he email me or write me a letter approving of my keeping the check. He did!
I printed out a copy of the email and kept a copy of the letter...envelope and all.
Keep a paper trail!
There is a lot of discussion in the legel and real estate areana about this. General law states that even though the note is in your name, his late apayments are going to do nothing but legally affect your credit. Regarless of what goes on, remmber that possession is 9/10's of the law. So, in a general (SC) real estate sense, the two of you are going to have to come to some sort ofresolution about this issue. You have no recourse. If the note does not get paid, when you go to buy another house or what have you, they will pull your credit and title history, and they will show that you have late payments on this house (a no no), and if you did get a loan, the attorneys at closing can hold up the closing until this issue is resolved. Now, ou can file a lien on the house, but that will only be effective if the house is in your name (title) and not yours. If the house is in your name, the note is in your name, then filing a lien on it will be like you punishing yourself and we do not want that. My advice? Talk to your attorney, or have him/her talk to a real esate attorny and get this issue resolved this way. Once more, I am not a legel professional or real estate professional. I just know some things, and if you take my advice, then I hope that it works out. My advice (once more with feeling), find a real estate attorney!
