Well it looks like im back to the place where I startedexcept that im here now for advice from those of you who have been through the divorce process. I am hopping that somebody can give me some insight on how things generally get split up when you finally get divorced. Here is my scenario, My stbx makes more than 2x I do in the salary department. This does not include yearly bonuss and raises for this year, which now could be more like 3 or 4 times what I make. She delivered what is a rough draft of the divorce. Basically stats that everything is 50/50. Well with our debt load and now having 3 mortgages (current house, her house, vacation property) Her lawyer has it written up that I am responsible for half. Well when you do the math this puts me in the hole about 1k every month. I know the first thing you will say is well sell some things. The vacation property is up for sale but who knows how long it will take and if we need to unload right away I know we will not break even with the current market. So that puts me further in debt. I could sell the house that I am currently in but the difference a month between the current mortgage and new one for a house half the size would be about the same. Only a couple hundred dollars a months different. From a financial point of view It doesnt make much sense to sell it. My problem is we have pretty much split everything already. She went out and bought all new furniture for her new place with OUR money. Fine by me, its for the kids. She wants me to sign this document from her lawyer agreeing to this. I said I would not until a lawyer looked at it. I guess my question is if the income is different as in our case am I really responsible for half? Would the court order me to pay half and then not be able to put a roof over my head and the kids. Which by the way custody is 50/50. I dont see how they could it will put in the poor house. Since we separated bank accounts I dont know how much her raise is and or if she got the same dollar amount in bonus this year. I told her that I was going to take 3k out for a retainer fee and her response was why do you need a lawyer? You will be fine lets just get this over with. Seems to me she is trying to get out of what maybe rightful mine. I dont know how it works. Maybe I dont deserve anything other than 50/50. Doesnt seem right but maybe thats how it works? All I really want is to live from month to month with out having to go into debt. And if you have read my bio my health has not been the best this last year dealing with the cancer and all. Im out of the woods for now, just have to keep the fingers crossed that it doesnt come back! Which adds more debt to me that she doesnt seem to think she has to be responsible for. Whish is true if we were divorced but we are still married as of now. So if you have any advice PLEASE share! Im trying to find a good lawyer,,,which is no easy task either. If you have additional questions feel free to ask. Sorry about the long post, I am just worried that she is trying to pull a fast one on me and she is not looking out for the best interest of the children.
