I clean this woman's house every Thursday at 11:30AM. I went today and because her driveway was all ice, my car slipped down to the end of it (it goes down). I got out of the car and fell on the ice, just scratched my hand. I had to get towed, it cost $50. I called the lady and asked if she could pay for the tow since she never cleaned the driveway for me. She yelled at me and told me that I was tresspassing because she called me and told me not to come today, which she didn't. Can I sue her for pain and suffering? The whole experience has my very upset and crying, not to mention a trigger to my wonderful bipolar downside, and I have to work a new job tonight and my head needs to be clear (will it be? I don't know.) Does anyone have any info, has this happened to you? What should I do to protect myself from her threats? Should I try to sue her because she was such a bitch and really traumatized me?

I'm trying to exercise daily. I was doing fairly well until I sprained my ankle 2 weeks ago but now I'm getting back on the horse. Today I walked over a mile with my arm weights that are about 22lbs total. I was out of shape and it was hard on my arms. I also did my 30 situps. I'm also going to drink a lot of water and try to eat healthy. I do tend to have a sweet tooth but I'm cutting...
Pain and suffering are usually based on actual dollar damages, so the answer to that question is no. No lawyer will take that case as there will be no payout.
but if you feel itl make you feel better
What form are her threats taking?
Do you want to go into a court room full of strangers(all with their tales of woe) wait your turn, then sit up on a stand and tell your side of the story?
Best of luck...but consider carefully first!
I have a driveway that is on a private road and someone tried to sue cause her pants got dirty. I told her try as you might the road is not owned by anyone and we don't have to maintain anything if we don't want to. You chose to drive down a private dirt raod and you chose to get out of your car just because you did not see the puddle does not give you the right to send me a dry cleaning bill.
I won. She went to the hall of records and the road is not owned by me or anyone and that us filling in a whole with dirt instead of sand is perfectly legit.
It was a cost thing. I had dirt left over from a project.
Shoot your own feet. I will be even more cautious now!!!
Get an estimate on your car repair cost. Report the incident to the police. File a claim on her homeowner's insurance. Of course, you have to consider the headaches this is going to cause you and whether it will be worth it. I'm thinking not.
Try to relax(yeah...easier said than done ...I know)..but I really think everything will be ok.
Did your car hit something, you said it drives all shakey now...if it hit a telephone pole or something like that..maybe YOU can sue the phone co?
