Does anyone have any experience with probate court. Here is the story. My ex husband passed away this past feb. My stepson was assuming he was the beneficiary so he went and hired a lawyer and told me to stay out of everything it was non of my business. Well, I was named the beneficiary on everything. So in the meantime, my stepson appointed himself estate executor. Because my husband and I were divorced, I am not responsible for any bills, and I was the beneficiary on his 401k and his insurance, and his checking accout. There is nothing for him to be the executor on. He did own a house, but we are letting the bank take it back, and his personal belongings have already been split up with all the family members. I guess what I am asking, is it necessary for me to go to this court, or is it just a hearing where they name him this and that is it. He will be responsible for paying his taxes next year (if any). And maybe dealing with a few creditors. I need some advice.
