Short and sweet...the hospital called...the administrator..... explained to me how hard they have it and since I'm unable to work my scheduled appointment time they are going to post my position to the public to replace me.... a nice way of saying you're fired.... now what? I've asked before but does anyone know a very good lawyer...willing to give up my right arm!

Ive worked in many hospitals for the past 6 years.
First of all.. what is your status? Are you pt, ft, or per-diem? If you're per-diem, you dont really have much ground to stand on. However, if you are pt/ft and out on medical leave, you need to go to the next higher up. usually the CEO , nursing administrator, not the supervisors, the Nursing Administrator for the entire hospital. Id also talk with HR.
If you're on medical leave, they are obligated to post the postion through the nursing supervisors office, as inter-hospital and allow others to pick up your shifts as OT. But because we are in a recsesssion, I am willing to bet they would rather replace you, than pay someone time and half.
I know several awesome lawyers but dont know where you live?
You need to first contact the division of hours and wages.. and report the incident.
You can find a good lawyer in the phone book, they have certian lawyers who specialize in workers comp, lost wages ect.
A good lawyer who is confident they can win wont ask for any money up front! They will take the case on and take a precentage of what you win.
Be careful who you talk to .. and who you trust. Ive been blackballed before from some of the hosptials b/c of hr people talking back and forth.

A lawyer does seem to be the way to go.
Do you have a union ?
Can they do this legally.
What about filing for disability ?
If your doctor says you can now work, you can't work.
