Feeling a bit better ....
Posted on 11/07/09, 07:20 am
Just an update..... We were on the hone to our lawyer for 2 hrs the other day to figure out how we got to the stage that we have with all this crap and where it is going.....I finally got the "un-sugar coated" version of what the victim is accusing my husband of. (I was not able to hear or speak w/ the lawyer as I was a possible witness and only heard the version from hubby and his parents...) I am more comfortable w/ how this has to go (he pleading to the 3 lesser charges) as given all the evidence, he has no hope in hell of beating this case. A lot of he said she said and a bunch of lies but, an MSN message btw her and hubby was produced and it will stick to show her case......the conversation in it is typical of what they would say around all of the adults but, that is how my family is (hard to explain) Basically the lawyer said to thank our lucky stars that the Crown is a complete idiot! She has no clue as to what is going on and we will get what we want (least possible sentence) because she doesn't know any better. So, that being said, the way the laws were on the supposed incidences there is only one charge w/ a min sentence of 45 days. The other 2 have no min and since the aligations are the most minor of these offences and hubby has no prior criminal record the lawyer says that he will likely get 45 days to serve on weekends and a possible 3 months house arrest as he is the sole provider for our family. ~~I KNOW THIS IT A LOT DIFFERENT THAN WHAT MOST WILL SEE BUT, DON'T FORGET I LIVE IN CANADA~~
And on a happy note too, I had to go in and talk with the person doing the pre-sentence report (who was amazing and will be hubby's probation officer if he get probation?) and she said that her report will be nothing but positive. She has a hard time believing that these aligations are true but, is going to help us out how ever possible :) She said that we are already doing (or have done) everything that she would suggest and will make sure that it is said so in her report. This w/ our children services case being closed in June, the risk assessment coming back at 1 outta 26 (only cuz he had charges pending) and the counselor having an amazingly positive report......I was on cloud nine my friends :D
I am feeling the best that I have since all the crap came about last August!!!!

I'm so happy for you. Sure wish I lived in Canada when all this happened with my husband. They didn't have any prove but what she said. They didn't care what my husband said. He got 5 to life and has been gone now from me for over 3 years. In the States they only listen to the so called vicitim, they will put you away and not even care or look back. With my husbands case they took the word of people who are Meth users. Take care and I wish the best for you -

That is just amazing! Hopefully, the outcome will be as you dream....Thankfully, you don't live in the US....Things are only getting worse...In England, they are starting to copy our S/O "laws"...not good, at all! Love, Barbara -

Yupers......I am so happy that things are looking so up for the case!
As you can tell in the States it is not as they like to say it is....innocent until proven guilty...it is lets believe they are guilty.....and make a case out of it and then throw away the key.....sometimes it all comes out okay....but unfortunately not the usual thing......so we are so happy your courts are not like ours are most of the time. We keep praying that they see how messed up their thinking is and decide to believe innocent until thoroughly proving the guilt......it is in most of ours prayers daily that they see the light!
But back to your case.....we are thrilled it it looking that way and will be praying it continues in that vein for you and your hubby!
Love and prayers for continued good news for all in the process!
Love Rhea
