DD has MR and State refuses to approve services

We lived in MO. 1994-2002 and DD had a Medicaid Waiver that provided all services to assist her, OT, PT, Speech, Counseling, etc. plus a Personal Assistant for approx. 100 hrs./mo. This was a huge help to her, she progressed, had community intergration, etc. My marriage fell apart, and I had to move to OK to be near family. DD's "waiver" did not transfer b/c it was partially funded by Federal and State funds.
I put her on the 2,800+ waiting list in OK as soon as we moved. It took 3+ yrs. and 6 inpatient tx's to get her name to the top of the list. The intake people came to my home, approved her for an In Home Support Waiver in 2005. One week later I received a call from the intake worker, they requested I take DD to a specific Ph.D. for an "IQ test". He did a screening, not an IQ eval. and got an IQ 20 pts. higher than anyone else ever did! They denied her waiver. I have been fighting this since, filed for a "fair hearing" anf that was corrupt also. DD's case is still open, but she has NO services-sits and watches movies, TV, when not in school. I have volunteered on committees here, met with my State Rep., and written to everyone I can think of. This State is saying that DD's MR is impacting her dev. disabilities, and Oklahoma does NOT have mental health parity laws. I am a single Mom, and care for DD 24/7, no respite. My family is in denial, and we do not have any help. Any suggestions? DD is 18 now, and the court has given me guardianship. They saw the need!!! DD is in school, on an IEP, based on MR, Emotional d/o, epilepsy....she is in eleventh grade working on a fifth-sixth grade level. I feel that OK just doesn't want to give her the services she is qualified for, blatant neglect by this State! Posted on 01/06/08, 12:01 pm |
