Yeah so.. I got a phone call at 3am last night. It was my boyfriend, letting me know that he was in jail, and had just been arrested for possession.
As far as i knew - he said he had been like 3-4 weeks sober, so i have no clue as to why they found 5 balloons of H in his car. But they did tell him that he was being charged with possession, not dui - because they didnt believe he was currently using or high at the time. Now, i'm young, i'm a good kid, i've never been in trouble with the law - so i have no idea what i'm supposed to do here. it was a thursday night he was arrested - so they told him if a judge has time to see him today, they will - otherwise he has to stay in there til monday. Is that normal? Judges just don't work weekends, so they just keep you there? I don't know how this bail thing works either... I have no money so i'm not about to bail him out or anything, but i'd just feel terrible if he had to stay there, all alone for the whole weekend... Especially if he was telling the truth and he was sober, and those balloons were old and he just forgot they were in the car. He doesn't have his suboxone, (if he really was taking it) so he'll get sick... oh, and another thing - his car was impounded in some lot nearby.. Would I be able to get it out? Or does it have to be him? I know it costs money, but does anyone know like if they charge daily for it to be there? I don't even know where this place is to call them.. Ok - sorry for all the questions - but now the big problem. I know in CA, just having H on you is a felony, and a mandetory 5 years in prison. But i think i read it has to be like over 5kg, otherwise its a misdemeanor? Does anyone know for sure? I know nothing about heroin, so I dont know how much is in a balloon or anything. I think he said they found 5 balloons, is that more than 5 kilograms? I just hate to think that he'd go to prision and be a registered felon, if he was clean and just didnt know they were still in his car... I don't know what to do, I called the station where he is being held, and they were no help to me at all. They said i'd have to wait to see what the judge would say -- thats it. I don't have much information to help you but as far as the car being impounded usually the the price to get it back keeps going up. I highly doubt your bf "Forgot" that he had heroin in the car. I know you would like to believe he is being honest with you but addicts lie. If this is the first time he was caught he may get off with just probation that is if they don't think he was going to sell it. Not really sure about the laws. Good Luck and you might want to think about staying away from him.

If you get arrested on a Friday nite, there is a Saturday bond hearing. Otherwise, the next bond hearing is on Monday morning. When a vehicle is impounded, the initial cost is between $95.00 - $135.00 to get the vehicle back, then every 24 hours the vehicle sits in the impound more $ is tacked on to the initial impound charge - in Illinois it's anywhere from $25-$50/day. Anyone who has the money to get the car out of impound can get it.

Sweetheart, ON ONE forgets they have FIVE balloons of heroin in their vehicle. I would be shocked if someone forgot about ONE; but FIVE? NO WAY. He needs to sit in jail and you need to stop feeling sorry for him. My son was recently arrested for possession, supposedly of 2 "empty" capsules, and he turned himself in and was released the same day. He has a court date coming up next week. I don't know if he will get jail time or not because this is his first arrest, too. I look at it like this, though. They NEED to sit there and contemplate what life is going to be LIKE if they don't stop making stupid dangerous choices!! He got himself into this mess. Let him get himself out. He is lying to you. It is a good thing you weren't IN THAT CAR with him when it was found. All of this is going to add up to quite abit of money. He needs to pay it himself. Don't help him!! You're young and you're a good kid & you've never been in trouble with the law, but that can all change really fast if you get involved with and stay involved with a heroin addict. I know you probably won't listen to me, but a smart girl would think about what is good for HER and walk away. Please; I'm not trying to be mean or harsh; I just know what you're up against & the road you are on is long and hard.

hun, i can completely relate. my boyfriend was arrested a year ago for both dui and possesion. he passed out at the wheel and hit someone! this is when i found out he was doing heroin. after months and months of detoxing, being clean, relapsing. we're back at square one. i'm in new york, so i do not know what CA laws are. but he was arrested on a saturday and arraigned on sunday. he went thru trial, and was finally sentanced to 3 years probation (which he manipulates constantly). he is still using, and it kills me daily. unfortunately, i love him too much to leave! it sounds like you are in the same boat. i'd love to talk to you more, i'm sure we could both use a shoulder to lean on and someone to talk to...i really hope so, because i'm in a rough spot right now...e-mail me PLEASE! anytime, shortiibaby@yahoo.com. good luck, my heart is with you!
