My husband made a really stupid mistake and is now in jail on a $10,000 cash bail only. He should have been charged with attempted shoplifting but because he ran from the police, they have charged hiw with aggravated assault, robbery and resisting arrest. My husband already had a pending case in front of the same judge and that is the cause of the high bail. My husband was about to be sentenced to 60 days for the first case. I have requested a lawyer prepare a bail hearing so my husband can post bond. What do you think the chances are that he will be successful in the bail hearing? If the security is shown, it will prove that no assault took place and the item he attempted to take was left at the customer service counter as my husband decided not to take it. Please help, I am going crazy over this.

I'm sorry you're going through this difficult time. Unfortuantly there is no sure way to predict of what will happen, since everything is going to depend on the judge, and how DA wants to present it. If either one of them wants to make an example of your husband than they can deny him bail, or you can have the best possible outcome on this. Until you're in that court room there is just no way to know.

My personal motto is: "Expect the worst, hope for the best". Unfortunatly in my experience with the judicial system it worked well for me. Good luck to you! "
