Sought After Cells Created by Catherine Rainbow for an undergraduate course at Davidson College. The Case of John Moore Adapted from "John Moore v. The REAGENTS OF THE UNIVERSITY OF CALIFORNIA et al." Supreme Court of California No. S006987 On October 5, 1976, John Moore made his first visit to UCLA Medical Center for treatment of his newly diagnosed condition of hairy-cell leukemia. Upon arrival from his home state of Washington, John Moore met his treating physician, Dr. David Golde. After multiple tests in which significant amounts of bodily substances were extracted from Moore, Dr. Golde verified that Moore had hairy-cell leukemia and had him hospitalized. Little did Golde know that upon observance he would find a rare type of T-lymphocyte that produced an abnormally large amount of immune system regulating proteins called lymphokine proteins in Moore's blood. On October 8, 1976 Dr. Golde strongly suggested that Moore undergo a splenectomy in order to remove his oversized diseased spleen to slow the progression of the cancer. John Moore signed a consent form permitting the operation. Golde then proceeded to take the formal steps to receive portions of Moore's spleen for further research purposes. Golde did not, however, inform Moore that he intended to use portions of his spleen for further research nor did Golde request Moore's permission for such research. On October 20, 1976, Moore's spleen was removed at UCLA Medical Center. Following Moore's surgery, Dr. Golde required the Moore return to the UCLA Medical Center for follow-up care and treatments. These treatments included further extractions of bodily substances from Moore. Unbeknownst to Moore, these bodily substances were being used for Dr. Golde's research purposes rather than for medical tests pertaining to Moore's health. Moore made multiple visits to the UCLA Medical Center from his home in Seattle from 1976 until 1983. Dr. Golde also directed Moore to only visit the UCLA Medical Center for treatment because his follow-up treatments could only take place there and under his care. In 1979, Dr. Golde and Shirley Quan, a researcher employed by the University of California, developed a cell line, a culture of cells that reproduce perpetually, from Moore's T-lymphocytes called the Mo cell line without Moore's knowledge. This cell line was commercially important because it could biologically produce lymphokine proteins at a lower cost than the synthetically manufactured lymphokine proteins. Dr. Golde and Quan applied for a patent of the cell line in order to establish and protect their invention of the MO cell line. They were both awarded the patent on March 20, 1984 with the Reagents of the University of California named as the assignee of the patent. During the waiting period for the patent, Genetics Institute approached Dr. Golde and the Reagents in order to gain the privileged and exclusive access to the MO cell line in exchange for thousands of shares of its common stocks, high paying salaries and fringe benefits. The transaction took place and Dr. Golde began to receive payment for his invention. John Moore became suspicious of Dr. Golde's treatment regimen and began to question him about purposes of his visits to UCLA Medical Center. Moore even asked whether Dr. Golde was specifically using his bodily substances for any commercial endeavors. Dr. Golde denied Moore's allegations and discouraged further questions about possible research results. Moore's suspicion reached a climax when in September of 1983 he was asked to sign a consent form that relinquished all of his and his heirs' rights to a cell line or any other type of product that may be developed from his blood samples. Although pressured to sign this form, Moore indicated that he would not give up his rights and proceeded to gain the advice of a lawyer. The lawyer determined that Dr. Golde and his associate Quan had recently received a patent on a cell line developed from Moore's blood samples (2). Moore then took Dr. Golde, Quan, the Regents of the University of California, Genetics Institute, Inc. and Sandoz Pharmaceuticals Corporation to court on thirteen different causes of action including conversion, lack of informed consent and breach of fiduciary duty. http://www.whoownsyourbody.org/con... http://www.mywire.com/pubs/Esquire... This was a story line very similiar to this on 'Boston Legal' -- except the condition was AIDS and the results were different. The use of the patients' blood, however, for drug developement, etc., was not so different. I plan to check this out...... Thank you....

A similar thing happened to our family. Two infant/toddler grandsons were identified w/rare immune. Told they may develop Leukemia, Lymphoma or other cancers. Told "genetic" so we had our blood checked. No link. Immunologist said "has to be environmental..." I asked about high voltage powerlines on blvd of our home which at time was daycare for both boys. Immuno said, "we do know that EMF's (electromagnetic fields) affect mice but we don't know how much of what happens to mice happens to people..." I had my thoughts re that but will spare you..... Many "angel incidents" later, I discovered each boy was sleeping close to an electric meter in their own home. Bottom line: we moved the beds (also took them out of waterbeds) and they "got well." Overall IGG's came back 100 pts and 204 pts w/in five mos of bed change which allowed their bodies to produce melatonin again. Due to my "extreme anger" at the American Cancer Society at the time -- I had rec'd a paper from them clearly marked 2 RAD .... recommending clocks and other elec items be moved away from beds -- they and gov't were not warning the public and they still aren't! Evidence exists, results re Leukemia especially are "conclusive" and still the public is not being informed. See my webite for addl items of concern: www.guineapigsrus.org Anyway, blood was sent to a researcher -- Dr. Fatih Uckun at the University of Minnesota. He was a pediatric oncologist also. Turns out, his studies are part of the EMF RAPID Conclusions that confirm immune deficiency and Leukemia is causally linked to low level EMF/EMR exposure. Studies can be located by "googling" his name, etc. and also on PubMed. Soon therafter, Uckun made a major announcement that he discovered "a candidate gene" for Leukemia." Later, the immuno told us that but added, "the gene is the same for immune deficiency." I strongly suspected the boys' blood was "the reason" for the breakthrough and was relieved that children would be helped but also believing that more children might not develop Leukemia because "they knew" how and why the Leukemia develops in the first place. Uckun left the UofM shortly after that. I didn't know then, but the Wayne Hughes Institute was being funded by the NIH and the DOD. The NIEHS/NIH funded EMF RAPID. SO, wouldn't you know..."unknown to us," THEY were using our grandsons blood to "make money" and to "not inform the public!" We were not "properly informed." I do not specifically recall whether any "consent form" was signed. I was there at each appt w/daughter and daughter-in-law and grandsons. LOTS of blood was drawn again and sent to Uckun at Wayne Hughes Institute. We believed allowing Uckun to have the blood at Wayne Hughes Institute would somehow help our grandsons and had no idea at the time that our grandsons' blood was the reason for the Leukemia breakthrough or the formation of the new alliance. I definitely suspected this -- first "in my gut" after the big announcement but then again, when immuno explained that since Uckun was leaving the UofM, and he couldn't take the boys' blood with him, that we needed to furnish blood directly to Uckun at Wayne Hughes Institute. I need to review patent applications which so far I ahove not done re Uckun.... I researched and learned that Uckun treated a boy named "Parker Hughes" (Leukemia). Sadly, the boy died but his father, Wayne Hughes continued with his support of the institute and another was formed called "Parker Hughes Institute." Google re Uckun and you will now find he is in plenty of trouble and his very license has been threatened. I do not know current status but it is not good. Isn't it interesting that I also discovered Uckun was no longer treating children after having been a pediatric oncologist for 13 yrs.? He began treating "mainly adults." My website has picture of Michael Boyum, a wonderful young man who died from Acute Mylogenous Leukemia. Uckun tried "last ditch efforts" to save him. I like to believe all efforts were "honorable." At no time did the immunologist inform us that Uckun was part of the $46 mil EMF RAPID Study. At no time were we informed that Uckun was an EMF researcher. No acknowledgement was ever received from Immunologist to me or family members after I informed him that the "reason" the boys "got well" was because we moved them away from powerwalls. In fact, he has to this day never commented on this extremely important information. The immunologist should have made announcements and more....... I didn't know all of that at the time I conducted my guinea pig studies. Two sets of two each were placed against wall opposite electric meter in back bedroom of our home. They all developed pre-Leukemic blood changes consistent with "markers for irradiation!" They developed asthma as their first symptom. Their CBC's indicated severe neutropenia, lymphocytois and hypersegmented neutrophils. Subsequent info is equally alarming but not surprising..... Mueller and "Newt Gingrich" or "Bill Clinton," "George Bush" for a sample of some of the appeals I have made on behalf of the public. I have tried to get through to Holly Robinson Peete and Jenny McCarthy via their websites -- re autism. Like most health problems, "largely preventable!" Linked to electric field exposures close to beds at night. Studies prove the link to low melatonin in Leukemia, Alzheimers, Parkinsons, autism and much more. WHO will help the people? No attorney has been willing to take the cases re the boys. I have tried "Civil Rights' attorneys also.... We need to force the release of the EMF RAPID Interagency Committee Report. That "exact term" must be used when demanding the release from senators, etc. NO ONE will even respond unless a "wishy washy" bunch of baloney. I have all copies...... You Tube may be the only answer. Oprah and Montel and most of the TV medical experts also do not respond.
