Collecting arrears after 18?

Hello,

My son will be turning 17 in December, which means only one more year of support from his father (which had to be garnished due to his unwillingness to oblidge). However..., because he also owes over $40K in arrears, am I still able to collect until it's paid in full? He lives in NM (I think) and I live in CA. The court order originates from CA and they have been collecting from him for several years now, but only $75 per month has been paid towards the arrears, and that arrears keeps growing because the state of CA also charges 8% interest.

Interest aside, he still owes many years of unpaid support. Will I be able to collect it from him? Will it still be automatic from the Child Support Services of CA? Or will I have to file a judgment for the remainder? Anyone know?

" Hi my ex owes me at present about 30K w/interest. In my state they keep collecting and the same rate or ? if I request a change until everything is pd (arrears and accumulating interest) in my case right now he pays aprox 300 for present support and 100 dollars towards the arrears (he earns more than that in new interest). Now an attorney did warn me that some states have a statutue of limitations on debt's .....whether that includes child support and what the details are I do not know.... so if this debt is getting older now....you might want to ask an attorney....... "

" I am 33 years old, my brother 30. My mother is still collecting on the back child support that she is owed. Iowa was were their decree was. Hope this helps. We are going after my step-son's mother as she only had to pay $50.00 a month and has not paid anything in 4 years. "

reb You can collect cs after 18. As for arrears ordres entered after 7/22/89, 10 years after emancipation of youngest child, for orders before 7/23/89, 10 years after a payment becomes delinquent. "
