Must come to an end. My wife says she is leaving me. And she also says that she is talking both of my kids with her. I am soo sad right now. What can I do to prevent this??? What rights do I have as a disabled person who loves his children and can't live with out them?? I couldn't live without my kids, but she doesn't care how it will kill me to be without them. I am pondering acting first. KInd of like a first strike type of thing. I am at a loss for words right now, and I have no idea which way to turn. I have come to love you guys and I value any ideas that you might have. I know this is just a shortened version of todays events as I do not want to bad mouth her, but it seems that I am being forced to act first. My mind is going a thousand different ways at the same time. I know that the relationship is past saving, but that no longer is a concern to me. It's just that it seems as though she has been planning this for awhile now behind my back. It hurts to be lied to, but my real pain isn't about losing her....to be blunt I could care less. But to be without my kids....well I know that I would end up doing something rash, and I don't want that. I need them as much as they need me. They keep me grounded far better than any med I have ever taken. If it wasn't for them I would have been in the loney bin long ago. I know that this is a personal thing and none of you can really intervene in any way that would solve my problems, but I needed to get this out to someone, as my family has disowned me. I am okay right now...just a little in shock.

Can a woman actually take the children out of the house?
My mom wanted to leave my dad. She was told she could only take the child she was nursing. She ended up staying with him. I feel so bad for you. When I wanted to divorce my husband five yrs. ago he told me he was going to fight for the kids. I ended up staying. I should have had him removed. It's hard though to kick a 6'4" 300lb+ person out when they don't want to leave. I do know of the pain. I am sorry you are experiencing it. T

thanks for all the info. I stayed on-line all night last night attempting to find out the answers to this question. I must have read through a dozen sites....but I never saw anything about custody and moving out of state before the divorce was finalized. They had a lot of info on out of state moves afterwards but nothing that stated the law, for if the parents where married.

Same thing happened to me about a year and a half ago and now I am going back in for new times of placement. I would keep your cool big time right now, if you get a lawyer don't let the lawyer talk you into anything that you don't want.

basically it depends on the state but all state stipulate that parenting is a equal responsibility..no one can force a person to say where thet don't want.keep in mind that polioce officers are not lawyers and canno't stop such an action,,it is natural to fight for the kid's,,everyone does but it must be in a court of law..you did't say what state u r in

that is the key word finalized...that is in correct it has to be who is the one who get's to court first to file who has physical custody of the child/ren at that time..if it is a breast feeding child.then no a father can not take that child but not for custody reasons but for health reasons..that child would be the final decision of the children..that is why i stipulate an xparte case..because that will finalize who has physical custody of a child during the divirce.but until such time that it is decided by a court of law either and each parent has the legal rights to any given child as long as that child can be provided for.

tech.you do nopt need at attorney at that point you have the right to petition the court on ur own behalf for the sake of a child everyone rich or poor has the right to a fair trial and hearing and a right for his day in court....i have helped in many cases and i hve used an attorney only once and it was more then a child action case..i am not an attorney and i don't say that i am but i know such thissngs as i have studied this...and have speant many nights going over legal briefs...but i am a laymen..but educated in these things and again it is in conjuctiopn of a claif law.

omg matt 74 is so right on..i can tell you that a judge looks alot at composure...and a lot on temper...so what ever you do keep both under control and i also can tell you a big point is never talk down about the othere parent to the child/ren....and i do mean never...
