The last two weeks of December, my jobe worked me 85 hours total. Most of the days were 8.5-9.5 hours and they would only give me a 15 minute break (a 30 if I was lucky). Against the law, very much so but was told "we are very busy and need you on the floor." Now I have not been given any hours since the 1st until the 18th. I went and asked the boss why and she said "you were in to much pain due to your back, so I don't want to work you." Okay, I would have been fine if I got the breaks I needed and deserved, and if I got a day off or two. I told her this and she just shrugged her shoulders. How am I supposed to pay the bills if i don't work for 18 days. I'll be lucky if they scheduale me after the 21st. Any advice on what to do.

" That is something else - they break the law and don't give you a break and then dont give you any hours the next week? With those days that you worked, they are supposed to give you more breaks than that, sounds like the boss is being discriminatory against you and if I were you I would keep track if you do get any more hours coming up what times that you take your breaks and stuff just in case. Just keep notes somewhere of what breaks they give you and what days you work. If they keep doing it and you address the problem with them, and they continue to do nothing about it at least you will have proof if something legal ever comes out of it. Good luck... "

" Like teenytania wrote, write everything down. If you need to take pictures too. They know they can't do that. They can get into big trouble for that with the government. & I hope they do! They make you work your ass off, then they don't even care that you don't have any hours. Hope you get some hours. Call OSHA, thats who you need to talk to about this. "

" What is OSHA? I have been writing the days I work, the breaks I get, and the pain level I was at for that day, and also what medication I needed to help with the pain. I just want to work 3-5 days a week, 6 hours a shift. I don't think thats to much to ask for. Before they found out I had a spinal injury, they would work me 25-35 hours a week, every week. They keep telling me that they don't want me to hurt. I am going to hurt if they work me or not, so why not work and get paid? I told my neurosurgeon what they were doing, and he wasn't to happy. He told me that if they don't get their act together, that he would help me deal with them. "

" I would if i were in your shoes have her document why you didn't get any hours and get a copy, you did not ask for the time off all you asked for was a proper break durning the christmas season and make sure you write that in there. It seems to me she is making excuses to cut your hours now that the holidays are over and really she cant just not schedule you,, you can claim unemployment for those two weeks.

get pushy and tell them this is not right and make sure it is in writing when faced with documentation they will get scared trust me. I was a manager for many years and know what they are doing and it is not fair. good luck and let us know what happens "

" I would say to look in the phone book for the Center for Independant Living that covers your area and contact them and ask to talk to an advocate. They can tell you exactly what your ADA rights are and step by step how to go about advocating for those rights for yourself and can refer you to an attorny for that purpose if need be. And CIL services are free. "

" Call your Department of Labor and file and wage and hour complaint. Sounds like they violated labor regulations by not giving you your breaks. I would also start looking for a new job. Best of luck. "

I want to work, and I can work- just as long as I can have breaks to sit down and rest. One of the managers at the place I work now doesn't think its okay when I ask for a break. She says that if I can come into work, I should be able to work without a break. She also says that she doesn't get breaks either (which she does go sit down in back, just doesn't clock out- paper work; but still, she's sitting). Even before I had my spinal injury I needed breaks. I'm so very frustrated! "

" Here is a link to the Federal Department of Labor. Maybe it will help. While I understand that you can and want to work, it sounds like this employer is just not willing to work with you. As much as I hate saying this, it is probably going to get worse from here. You can go to your local Workforce Center and tell them what kind of job you are looking for and they will assist you.
