Applied once before surgery in 06 and then again in Oct 08 - and just now found out that I was denied. It basically said in the letter that I was still capable of "less demanding" work and I should seek out another job opportunity. I had 21 screws and 2 rods placed in the spine and have trouble sitting in a chair for extended periods of time, trouble with standing for long periods of time and have not been authorized for lifting over 2 gal of milk. Can anyone tell me or suggest a job that would work with these limitations? I am not in a wheelchair but do have problems keeping my balance, etc. and still use a cane from time to time. Does anyone think that I should appeal the decision and get a lawyer or would that be wasting my time? They said in the letter that they "understand my discomfort", I think that these people are out of line in this decision but I am not sure what to do next. Anyone else had this happen and did you go back to work or fight them?

Yes I would say get a lawyer,in my expierience,there is no rhyme or reason to thier decisions. My dad was a conductor for Norfolk southern railroad,and he had a mild stroke but it made him lose his periferal vision,so he is lagally blind and cant drive. He got denied the first time. I was at the hearing we had to go to and the lady had a huge attitude and told him he could work at a cash register at a grocery store and look straight ahead. he later appealed with the help of a lawyer. and I have heard many stories like that.
On the other hand I have a close friend who has narcolepsy he is 28,and he had a job and took his strong medications to stay awake,it eventually got to the point he could not stay awake,so I finally talked him into applying and 6 weeks later he got it. and everyone there was friendly and nice and helpful. But I would tell you to hang in there and keep plugging away BUT get a lawyer!

try this. It has the conditions to approve. then if you can make you up a file with that codes he will problem would get approved you can hire a lawyer but some of them are slower than social security,if I can help anymore my email is ckelly5955@aol.com

I hired an attorney from the onset and had a check in my hand in 8 months. I was denied the first time and he won on appeal. I did a google search and ended up with an attorney in Utah and I live in California. You are wasting time otherwise. He was also able to get it paid retroactive almost 2 1/2 years.

i am now in the same boat ive been denied twice and now i have to have a hearing for anyone whos going through this or went though it can you please pass me any advice.i have no means of money im dead broke and whatever my wife make is for rent,car,insurance,etc
ive tried other means but all have failed i know i have to be patient but i dont know if i can go any longer with out money.all of this is making me go crazy and i hate that feeling of being stuck

Hi, I just had my 2nd denial & I appealed that as well & on the 3rd one you go to court & the judge decides weather your disabled or not. I'm fixing to go to court soon. I got me a lawyer before I filed for SSD, So their really doing all of the work, But the lawyer told me that I'm going to get denied not to get discouraged. They keep denying you in hope you will just give up & not appeal their decision. That's what my lawyer had told me. Just keep fighting, It's going to be a long ride. Call a lawyer & see if they can help you w/ your case. Just see what they say. You do win, You don't pay them. You win, You pay them out of your back pay from when you first filed SSD. It wouldn't hurt just to call. Good luck & best wishes
