Why was I denied twice for disability?

Applied once before surgery in 06 and then again in Oct 08 - and just now found out that I was denied. It basically said in the letter that I was still capable of "less demanding" work and I should seek out another job opportunity. I had 21 screws and 2 rods placed in the spine and have trouble sitting in a chair for extended periods of time, trouble with standing for long periods of time and have not been authorized for lifting over 2 gal of milk. Can anyone tell me or suggest a job that would work with these limitations? I am not in a wheelchair but do have problems keeping my balance, etc. and still use a cane from time to time. Does anyone think that I should appeal the decision and get a lawyer or would that be wasting my time? They said in the letter that they "understand my discomfort", I think that these people are out of line in this decision but I am not sure what to do next. Anyone else had this happen and did you go back to work or fight them?

" I was also turned down twice for social security disability. Then because I was going through a company called Allsup, they appealed the decision and got me a hearing with an administrative law judge who had a doctor as a witness. The doctor sided with me and could relate to the pain I was constantly in, which made it impossible for me to physically or mentally perform any kind of job. Do yourself a HUGE favor and get a disability attorney to take it from here for ya. Hang in there, because that's what Social Security wants you to do is give up. No matter what, keep your claim going...you won't regret it, I'm sure! "

" I had no idea that it would be this complicated...Thanks to everyone who gave me info on this, I am definately thinking about contacting a lawyer because this is not all in my head about the chronic pain and I am going to fight this. I honestly think that if I would be able to sit for hours on end without being in pain I would totally go back to work now, but that is not the case. Anyway I sit, lay etc causes pain and Im not sure if the doc is on my side about this, he mostly does the operations on teenagers and they bounce back "quick" according to him, but I am not a teenager, I will be 29 in a couple of days and have dealt with this chronic pain for at least five years. Thanks for all the help! "

" My experience with this is that the paperwork was not convincing enough and fill out improperly. What I mean is this... you must be so specific and long drawn out step by step, minute by minute, explainations of how your life has changed fro, ability to work to no ability to work, example:

I wake every 1/2 to 1 hour ea. night from pain and I never sleep more than 2Hr.s at a time....
When the alarm goes off I am so tired It is almost impossible to get up and move.
When I do wake I must take my pain medication and lay in bed or go back to sleep until it is relieving the pain or I just cannot get up and moving.
Then I have a real hard time taking a shower or a bath as it is difficult and painful to move the way I need to to wash myself,
It is very time consuming and difficult to get my self dressed.
Even brushing my hair is painful.
By the time I am dressed and have tried to eat something the pain is too bad and I am too exhausted to leave to go to the job or appointment. I have to rest and take more medication to leave the house.
When I go grocerie shopping it must be for 10 to 15 minutes and no more or else the pain becomes too much. Just driving 5 min and 10 minutes shopping is too much and I have to go lay down.

Do you see what I mean by specific??
Tell them every little imbarrassing detail.
difficulty using the restroom for bowel movements
must have people drive you or do your shopping for you. All of it has to paint the picture to show that you are not able to provide for yourself.Then the reality of disability is not so nice to live with either especially if you are like me and are too young and haven't gotten enugh monies put away yet.. It ts crazy trying to live on $500.00 or $600.00 a month, no matter where or who u live with. The only saving grace for me is the medical coverage.
Good luck. There are places who will be legal help for u to appeal and will do it for free. I suggest you seek legal FREE representation on ur next appeal

" get a lawyer and do it again. You'll need to send him all of your paperwork, and they work on commission by law. You have to be denied twice before they can step in. You'll need all of your medical records to give him as well as your tax statements and list of incomes . If they think they have a chance of winning they will take your case, if not they will probably deny to represent you. Back pain is a hard thing to proove with the disability dept. Its getting harder and harder to proove cases and the disability dept now wants us all off the rolls if at all possible, so an attorney is the way to go. "

" Please get a lawyer and then stay on them. Call the social security offie ever other week. It took me from 2002 to 2004 to get mine. Do you know theres a list that social security lookds at and thats what they qualify you on. If you like i'll get the web site for it. Don't give up we lost our house and had to move in with my daughter but i final got it. I think they won't to turn people down its seems like a game to me they try to out wait you. any you quit. "

then click on the adult listing. If you can find a couply of these that
relate to you this will help alot and if you have a doctor willing to fill out the paper work. I would even write or take this list to your social security office and demand they put this in your file and resumm it also the lawyers know about this site and if they use it work for work they can't deney you.
Adult Listings (Part A) you have to be very persint about this, calling them calling the attorney write to your local congress man. this are the tihings that helped me and shortened my time before I got social security "

I am totally disabled. My doctor and P.T. have wrote contact notes stating this..
They dont like to part with their money ( which is really our money)
Keep trying. that is what i am doing.
Some people say it takes a lawyer in order to get it??
